Quote from: Nik da Greek;758094Maybe it\'s because I\'m trusted to control a 100mph 300 tonne projectile without ending up on News At Ten for killing 800 people that I expect to be considered able to walk up a concrete bank without tripping over my own feet, injuring myself and suing.

To be fair Nik da I fully expected u to fall down the banking in ur "special" boots! ;)

Ok...everyone who\'s run themselves over with their own car can sit down and shush!!

Well, I was not there as I gave it a miss!! But reading from what Clive has written, I just wanted to make a small input,

"Clive, No Matter what steps you take and no matter what actions you adopt, Under the Unfair Terms Act 1977 (section 2) (Subject to the exception of those statutory instrument, which are not covered by the Act), you can not exclude liability for personal injury or death"  (my this statement is proven in your earlier post, "your friend claimed for supposed back problem, despite the fact that the sign of exclusion "wet floor" was displayed). So looking after the people and looking after cars etc etc etc, will never ever exonerate Brooklands from personal injuries claim or H&S Claims, Under H&S Act 1974, if the reasonable care and thoughts are shown by any organisation, They may be able to defend the claim of breach!! But defining reasonableness is very difficult (there is a legal definition for it, but I don\'t want to give a law lecture loll). The prevention of risk or damage will only benefit them (brookland) in two areas,

First One, the reasonable duty of care test will be passed (dont know to what extent, depends on the merits of the case) and

Secondly the individual may be held as contributory negligent

The effects of both are, that the damages awarded would be reduced, thou not substantially and it does not have any effects on Cost, As per Civil Procedural rules, Cost of any civil litigation is "Discretionary"

So as far the above is concerned, I can see their (Brookland\'s) point and also concern,

But, treating grown up people in a judgmental way as oppose to a non-judgemental way is beyond my comprehension! I think everyone is grown enough to understand the consequences of their actions and wont voluntarily (unless coerced) do something, which would undoubtedly bring otherwise name to the MRC..

Secondly, there is a good defence in law, for voluntarily assuming the risk i.e. see games like boxing, cage fighting etc etc..

The reason I am advocating for those who have not had a good time is because, I am sure they were looking forward to it and drove from far far away to attend and then they see themselves being treated like a risk is not really what they thought off.. I think the best practice would have been reasonable directions to the people, instead of "oii do this and dont do this"

I hope my post is not taken in a wrong way, neither it is designed to disrespect anyone nor otherwise, rather, I am trying to forward my thoughts on the feedback I have peruse from above!!

I have learnt all this in Tescos, as I work there as a GSA :)

One last thing to mention, Clive, in my opinion, your concern about H&S is perceived genuine by me, as you have everyone right to defend your and the clubs name, but at the same time, club member\'s first point of contact is you, so unfortunately, you have to listen to all...but off course everyone should forward their concerns in a constructive manner.. I hope have forwarded mine lollll :)

Hi, I don\'t want to join any debating society - lets talk the whole thing up.

So great day out, thanks again Clive and Lisa and looking forward to this again next year.

Test Drives Unlimited

To be fair with the guys at the Gate,I think it might be rather confusing for them,as most of the cars coming through the gate are either RX-7\'s or RX-8\'s :D & weren\'t expecting normal looking cars i.e Jojo\'s RX-4 or that matter my Black MPS coming to the Event & even more confusing, was the car arriving on the Trailer towed by a BMW :rollin

Anyway I do hope this take\'s place next year,as it\'s a great Event & a good place for all of us to catch up with each other :Thumbsup!

Just to round off.
Yes it was a good day as far as MRC was concerned
Yes I enjoyed talking to others about their cars and mine
Yes i enjoyed looking at the old relics and picking uo some ideas for the next creation.

All Brooklands need to do to improve things is go on a people management course to learn how to talk to people in a civil non hitler manner.

And it seems I am going back there as I forgot about the lancia day on the 30th. Yum yum stratos and 037:cheers

Very well said Syed, blimey we need people like you to be full club members to be able to have a proper say in the members section to assist direction,

Your right I have to listen and indeed I want to listen because information is everything and if lots of people are having lots of aggro I need to know so we can make the decision as to the future of this event,

Nik your comment about cow pats and open fields is right and I know you would attend, trouble is collectively our people don\'t want to do this, look at Bromley Pageant as a prime example, what did we have eight cars :Hammer.
All the best Clive

Brian, I was told on the day what had happened and felt that if their were real issues you would have told me there and then, shame is I need first hand info on the day really to even think about addressing things.

I am going to the next Breakfast meet at Brooklands but before then hope to go armed with a better picture to discuss attitudes of not and the future of the event as people hopefully come forward with more info for me.
All the best Clive

I had no problems tbh... apart from the entrance road being in shocking condition lol, Had a lot of fun, they told us not to go up the banking, so really, that should have been all they needed to do, as soon as we decide to ignore their talk and go up the banking, any ability to sue etc. should be out the window as we had been told but decided to ignore...

big boys (and girls) should be able to look after themselves and if they do something wrong, on their own heads be it, each person should take a personal risk assessment (as we do every day, like crossing roads, or driving full stop) to decide if it is within their abilities to do something of if they will hurt themselves, just a shame that its all gone too far with the claim culture.

Anyway, I had great fun, I am looking forward to Rotorstock!!!
