£60 fine for not being in full control

Sarnie almost as bad...?Eating a cheese and pickle sandwich while driving resulted in motorist Keith Pemberton being pulled over and booked by police officers at a roadside checkpoint on the A49 in Cheshire.

He was fined £60 and got three points on his licence after being convicted of not being in full control of the car.

Pemberton told the BBC: "They said I had not been in proper control of my car, but it\'s not as if I was swerving all over the road or driving badly."

The Cheshire police said: "The officer was right to give this driver a ticket. He cannot have had full control of his vehicle if he was eating a sandwich at the same time."

Road safety campaign Safe Speed said: "Cases like this illustrate the gulf between official and real road safety. It is vital that drivers are in proper control of their vehicles, but proper control is a state of mind, not a simple matter of what drivers are doing with their hands.

"The problem is that driving is largely a subconscious and highly skilled activity. The authorities can\'t see it or define it, so instead they seize upon what they can see.

"Eating a sandwich while driving can be safe or dangerous. It depends on the circumstances and what the driver is paying attention to.

"Road safety is in a very bad way - the authorities need to move away from their over-simplified dogma and start asking skilled drivers what is safe and what is not. The gap is enormous."

I still say (and I didn\'t know Jeremy Clarkson holds the same view) that if you don\'t pass your test in the first 3 goes, you don\'t get to drive. If you have a license in another country then you need to re-sit it in this country. once you get past 60, you need to take it again.

You\'ll cut the traffic down, you\'ll make more people use public transport, the o-zone layer and all that won\'t be melted (or whatever :2Rolleyes so that keeps the government happy) we can have a little more faith in the people we share our roads with, driving will be a privilige not a requirment....and they better do this soon as it\'s certainly not getting ANY better out there....

Oh and maybe there should be a RULE that people should spend at least one year on a motorbike to improve road awarness.....not to sit at a computer and click a p0xy little mouse....

THEN MAYBE THE POLICE CAN ACTUALLY GO OUT AND DO THEIR JOB INSTEAD ON PICKING ON MOTORISTS FOR AN EASY LIFE.....

...or cycle around Cambridge for a year. Those that are still alive get to advance to the next stage!

Yikes! Everybody with a manual shift I bet now are papping themselves me included, coz every time I change gear, I guess I\'m not in full control!?

Remember watching the Traffic Cops programme on BBC a while back...in 1 scene, copper pulls a bloke over for using his mobile and gave him a right lecture...moments later you\'re watching the police in a high speed pursuit on a housing estate and he\'s giving a running commentary to base on an old style hand held phone! :2Rolleyes

I got 3 point and a £60 fine the other day.  I was travelling along a quiet road in my town at 11:30pm.  My wife rang me, and although stupid of me to pick my phone up, my conversation consisted of i\'ll be home in two minutes then put the phone down.  But in the time that it took me to do that I had flashing lights in my rear view mirror half a mile down the road.

When I questioned him where he saw me, he said i\'ve been parked down a side street all night when you passed me.....??  So obviously a highly productive night for him.

Anyway what really got to me was going to the police station to do a producer.  I was sat in a room filled with scallies, one who was sat next to me, who got an £80 fine and a slap of the wrists for threatening somebody with a crow bar then proceeded to smash up the insides of their house with the crow bar.

When I questioned the copper to say how can you justify giving me a £60 and 3 points which is probably going to bump up my insurance more than the fine, yet that little pr1ck gets an £80 fine and a slap for doing all that??

His response was, well you could of killed someone!!??!!  Lets look at it this way ok I was silly answering my phone, but in my defence it was:

1.) 11:30pm at night on a week day
2.) Very quiet stretch of road with full visability
3.) My phone call was a total of about 3 seconds to my slightly worried wife

Yet a scally gets in the long run probably less for threats of physical violence and acts criminal damage!!??

I suppose the one big difference is that the scally doesnt have any papers, doesnt pay thousands a year for taxes and insurances so not as easy to do him.

Im beging to hate this country & labour government more and more and I dread to think what state it\'s going to be in when my son is my age!

I got £60 and three points for doing 82mph on a dual carriageway (70mph limit) on a dry, sunny Sunday afternoon with no other traffic in sight.

I was less than impressed.

Though, I had been doing over a ton a few minutes earlier so it could have been  worse.

You can hardly complain - it was over the limit.

I damn well can complain.

The point of speeding is that it is only about speed, and has nothing to do with whether you are driving like a nob or not.
I could have been within the speed limit in wet weather, poor visibility and heavy traffic and genuinely been putting myself and others at risk yet not be fined for it.

So yeah, doing 80 in the dry warm weather with plenty of room I feel annoyed at being booked for supposedly dangerous driving.

Yet they dont nick smokers, surely there must be an arguement there for not getting fined.

nick nick!!!! I love this it\'s easy money boys! Does blinking mean your driving with your eyes shut? pheeewwww:eek: Blinking hell

nikp

Well, you knew the rules of the road, and the law governing speed limits, so you can\'t complain. Until the day where we are given personnal speed limits, that are adjusted by our age, car being driven, weather we\'re driving in, road conditions, then static speed will be used and you can\'t really complain about getting fined for it.

arg! That was directed at teabagger, not the first post.

The conviction governing the first post is truely madness (And can now happen due to the new laws created to combat drivers talking on their mobile phones)

I can, and I will. Furthermore, I seriously doubt you stick to the speed limit all the time so not sure where you\'ve got your high horse from.

And how do you rationalise driving along one handed while eating a sandwich to be less of a danger than doing 12mph over the limit in perfect driving conditions? You can\'t pull the "it\'s the law" argument with one and not the other.

nikp

Yeah, i\'ve been convicted twice for speeding. And, no, i\'m no angel (ALthough I do stick to speed limits in built up areas). I am also not on any \'high horse\', just merely commenting that you can\'t complain, cos it\'s a fair cop. I never complained when i got caught - i was speeding. Fair play.

I\'ve also had a car towed, didn\'t complain about that even though realistically, it was not in anyones field of vision. I was on white zig-zaggy lines, and therefore I can\'t comaplain.

I\'m also bored at work, and trying to pass the time! :p

Unfortunately not.  Using a mobile while driving is, like speeding, an absolute offence.  You either were or weren\'t.  The only relevant mitigation is in the sentencing and you\'d have to risk going to court and facing a stiffer punishment than a paedophile.
