That was my thought too, after all I suspect a number of accidents are caused by "mechanical failure" of some sort. Say for e.g. a tire had a blowout on the m-way, technically a mechanical failure? can you imagine the letter?:

"Dear Policyholder, Regarding the recent accident which resulted in the damage to 12 cars, and 5 serious injuries was the result of the failure of one of your tires, we refer you to clause 3.55a of section 4 of your policy document. This clause states that any mechnical failure of the car or any part therein will not be covered by your policy. We regret to inform you that we are unable to cover the costs relating to this incident or any of the associated legal costs you may incur.  Additionally, during our investigation of this incident, we have discovered that you have, in the time you have held a policy with our company, travelled at speeds of up to 78mph and not 70mph as you had previously stated. In light of the fact that you have falsified statements relating to your cover we refer you to or policy notes relating to the legal ramifications of false statements on insurance documents. Yours Faithfully, A. W. Anker (Senior Insurance Assessor)

FD or not FD? that is the question.

If they are reading the this forum, I would like to see their faces when they read this!!  They will sh!t themselves.  It must be obvious they are screwed.  It would make good and obvious business sense to come good on this claim now, and on top offer some compensation for the \'mix up\' and distress caused, sack the guy who has dealt with your claim (as he is obivously a muppet) and blame the engineer.

I for one will go to every forum i\'m a member of, tell everyone I know to avoid this cowboy, scamming insurance company. If, and it is very likely, that everyone on here does the same the potential damage to this company will be huge - they would be fools to carry on down this avenue.

There only chance now is to rectify it - and then some.

Just noticed the \'active\' users on this thread just at this minute - it includes 26 guests!!  Sounds like the word is getting around already!!

F#*k me i\'ve just picked up on this thread! can\'t believe the tightness of them, any excuse!

I\'m still insured with high way at the moment, but don\'t have the FD no longer. I also was told by my brooker that High Ways no longer insure grey Imports (could be wrong). So that could be why hey don\'t care about all this bad press! I know who i\'l be warning people away from.

Quote from: BlitzBoythe reason they are not paying because of mechanical failure of the fuel line at the end of the day

The wife spoke to her friend at work today Blitz, and mentioned something similar to what you have written here. They wont pay for the mechanical failure of the fuel pipe, "But" they have to pay out for damage done as a result of the fire being caused by the mechanical fault, if that makes any sense.
Heres a list of what she suggests for you (alot has already been mentioned I know)

*Check over your certificate again

*Highlight the fact that you were driving on a public road at the time and that it is covered in the terms on the certificate

*If you can get hold of the previous owner regarding any mods done ie to the fuel system etc and did he tell you. ( unless you have had all the work done since stock).

* Who did all the mods, can it be varified by whoever carried out the work.

You\'ve probably done all this anyway but it all helps build a strong case for you.

Oh and she did say Highway were useless!

Hope this helps

Blitzboy, I\'m really sorry to hear about this.  Insurance firms are a total joke, the story has made it\'s way onto the S2000 forum as well.  All the best getting this sorted.

Lets hope Highways Insurance read these threads and relise they have made a bad call.

Maybe I\'m being an idiot here, but I thought Nitrous if used, was usually mixed in the air stream, plenum, carb or other suitable area, and not injected into a fuel line !?

To run a pipe with both a fuel and oxidant is lunacy of the highest order - that engineer must be so incompetent if he thinks that is what has been done with your car.

Seems their \'Engineering Expert\' doesn\'t match up to the qualifications he should have to do his job - as Brett suggested, I think you might even have a case against his incompetency - talk about fraudulent claims and statements - I believe under English law that swings both ways ?! :)

Good luck with your claim Blitz...

Blitz been following this thread for a while, really hope you get it all sorted!    Can\'t believe the bulls**t these people are coming out with!!! :(

Nail them to the wall for this one mate, win and get as much money as possible out of them, sue them for all the stress and hassle this has caused you.   Normally I\'m against the American suing culture but in this case I think Highway robbery needs to be taught a lesson.

I really do wish you all the best with this.

The Engineer could have got confused with the water injection system combined with the fuel t-piece found, which I\'m sure RE:worx will set the record straight on that one. Also shouldn\'t the Engineer be independent from both the insurance company and the owner? ( i think this was mentioned on the XR club thread).

Good luck with it Mark and perhaps look into getting an independent assessor  (Engineer) to check the car over before it is picked up.

WI has never been fitted to my old car, I have asked for my "T" piece to be sent back to me, so I can see what this Joker has actually taken off
