Best of luck persuing your claim. I am glad that i\'m not with Highway!

An additional note: They cannot use anything you say on the internet forums against you in any way. You are not under oath on here and could by lying through your teeth, or for all they know, 10 different RX7 owning friends of yours could also be using your account and maybe these friends do race their cars etc. To be honest I can\'t believe they even mentioned that!

Thanks for all the support from all the different car owners :)

Yes I realise they cannot use what I write on here in the case, but I have tried to be very open and honest with my comments , and disclosed all the facts from all sides

Dub Boy Matt

Hi mate  , picked this up from a VW forum.  This is absoloutly shocking, i\'m also with highway. I won\'t be using them again, most of the people on the forum where i saw this won\'t be using highway either!  Big forum too over 3000 users!

All the best dude.

Good luck with this one mate, really hope it all works out for you.

Just posted it on SXOC and its already on Dritworks.

I can imagine the monkey dealing with this thought he was being really clever by bringing the forums into this. I can imagine how clever he will feel when his management realise he has sh1tcanned the company in a thread read by 17,000 of their target market. Say bye bye to your job sunshine:WaveBye

Good luck with this matey

Damn Straight, he deserves it and I reckon Highway insurance will either have alot of grovelling to do to get us people back on their books or they will simply stop covering modded cars, either way we win.

I do hope im wrong about what is said on here being used in evidence as Phil pointed out, it was just a concern that I chose to voice.

Hi from Volkszone

http://www.volkszone.com/VZi/showthread.php?t=289715

Apologies if I\'ve missed it in the thread, but have you actually posted up the policy wording about mech failure that they are relying on ?

Could you (scan it and post the pic maybe if its a pain to type it out ?)

Not seen the policy, so obviously can\'t be sure, but - as a lawyer, but not an insurance lawyer or expert - I would be very (very!) surprised if they are right about this.

It would be worth knowing what the policy actually says though

If you are right - and your policy confirms this - IMO you should be prepared to look at taking this to Court.  What\'s your claim worth ?  If its less than £5K you would probably be on the small claims track, very informal, very limited costs risk for you

Start here:

http://www.dca.gov.uk/civil/procrules_fin/contents/parts/part27.htm

If you go this route, read the rules carefully, and read everything you get from the Court carefully - you don\'t need to be a lawyer, all the info is there, you just need to take your time and be careful

Best of luck, and post the wording up ?

I really think that\'s just not right (I\'m meant to know about this stuff ;) )

it might not be as strong evidence as other forms of evidence (such as oral witness evidence in Court), and if there was any real doubt about who said it then it would be very weak evidence,  but there\'s no bar at all on it being used....  (in a civil case such as this anyway)

[EDIT:

Is this, what the policy says ? (from the Highway website, standard car policy)

If so, I agree 100% with previous posts on here - this is not an exclusion of damage resulting from mech failure, it is an exclusion of the cost of remedying the mech failure itself.

In the same part of the policy, where they mean to exclude damage resulting from something, they use that exact phrase.  The \'presumption of internal consistency\', as well as the ordinary meaning of the words used, means they haven\'t got a leg to stand on

Finally, if you get no satisfaction, why not drop this guy a line:  http://www.highway-insurance.co.uk/highway/uploads/press/LeeRadleyapptV3-04.06.pdf  ;) ]

Yes Cheeky thats exactly what the policy says.

Well Im going to wait for their final word in the next ten days, if they still say no, then onto the Ombudson with the case, then if still no joy then I was use my legal protection to pursue it

I doubt your legal protection policy will cover it - check its terms carefully

But you can do it yourself in the County Court very easily

this leaflet tells you how

This is really bad for you BlitzBoy, and I hope the whole thing goes in your favour in the end.

I am only surprised John Yorke hasnt come on here and said : "this thread needs to be locked until we get the vendor to state their side of the story"

I am glad that for once we have the Customer\'s bad experience out in the open, and people power seems to be doing some damage to Highway. I dont have anything against Highway, but any Company who treats Customers like dirt, and there are too many of those around, NTL , Tiscali, etc, etc...

Freddie

I have to ask....why are you doing all the running around????

What broker did you go through, as i don\'t believe you can get policies direct from highway themselves.

Surely they should be sorting this mess out for you
