Hi Guys,
Unfortunately I was involced in an accident at the weekend in the Rex.
It wasn\'t my fault. A van has caught my drivers side front corner while I was waiting to turn right at some traffic lights.
The insurance company is picking the car up tomorrow morning to assess the damage and I\'m hoping for the best.
Best of it is, the van driver kept driving! He phoned the police to get them to pass on his phone number to me, and after speaking to him on the phone he became aggressive and refused to give his registration number. Luckily after a trip to the police station I now have the details I need to make a claim against him.
Damage to the car is crumpled wing, scuffed and scraped bumper, cracked indicator lense, and I saw the cover from the headlight come flying past the window. Think the bonnet may be out of line slightly too.
So as you can imagine, I\'m not a happy bunny! :(
If the insurance company is coming to pick up the car, make sure you keep hold of the V5 and find out exactly where they are taking it and get some contact details.
Really sorry to hear about this :(
So sorry to hear of your accident. Really and truely the police should be doing him for leaving the scene of an accident, no matter wether he phoned them or not!!.... The police generally cannot be bothered with getting involved with things like this.
I got hit on christmas day about 10 years ago, the woman was driving on the wrong side of the road drunk and then ran off from the scene leaving her familiy in the car!.... I phoned the police and they really were not bothered at all, infact they refused to come out!!... A few weeks later I got a letter from her solicitors saying I was at fault and she now had whip lash etc etc!! It took three years to resolve......... Im the type of person who works hard and doesnt claim for anything but in this case now I really wish i\'d claimed for everything under the sun now, as it cost me £500 excess at the time (As I was in my early 20\'s) and three years to get it back.
My advice would be to go for this guy by the throat and dont let go until you\'ve bled him of everything you can..... He deserves everything he gets!
Don\'t worry nobody\'s getting any documents for my baby! Luckily I work for the insurance company I use so I know exactly where the car is going to be and who to contact if I\'ve got any problems.
Yeah the police have said they don\'t need to be involved anymore as no-one has committed an offence. So it\'s down to the insurance companies.
The third party are now also claiming that I was on my mobile at the time of the accident (I wasn\'t!!) and not paying attention  and he\'s obviously changed his mind about the damage to his van, telling my boyfriend the whole side of his van is wrecked, and telling the police it\'s just his front wing?!?!
Sorry to hear about this :(
Could you not hand over your phone records to provide you weren\'t on the phone and that he\'s a lying b*stard?
Good luck :)

Already rang Orange about this, and apparantly they can\'t give me the records, and can only pass it onto the police if they request it, but the police aren\'t involved!
Do you have an itemised bill? That will show outgoing calls, and your phone will keep a record of incoming. Under the DPA, you can request a copy of any documentation Orange may have that concerns you. (if it comes to it)
Good call on the bill Brett, except it won\'t show received calls. I would explain to Orange that under the Data Protection Act you are entitled to see all and any records relating to your account or to you - and they may charge you a maximum of £10 for that priveledge. If they fail to comply with your request, remind them that this is law in the UK and that if they fail to comply with your request in a reasonable time frame they are liable for heavy fines and a representative of their organisation may even be liable for prison time. They might want to rethink it then.

Thanks Prof, I thought I was entitled to it! as we\'re always told at work that customers are always allowed to view their own files if they request to. I\'l give it a go!
Orange will have to show you your records and there should not be a charge, however they will find it very hard to give you the info relating to incomming calls. Most of the helpdesk will not know how to request this information but ask to speak to a manager and they should know this. If not explain the situation to the manager and ask them to look into it further. Sorry if this sound like i\'m trying to teach you to suck eggs but as an Orange employee (not in customer services tho i\'m afraid) I know our systems and what info they can access easily and what they cant. The info can be found but may take some digging.

Ahh right! Thanks for the inside info!

He was involved in an accident and didnt stop. That is a very serious offence. The police are just the biggest waste of tax payers money. I cringe at the state of this country I really do.
Sorry to hear about this alison hope it all works out for you

yes surely this is leaving the scene of an accident which i thought was seen as a big no no, surely you can get him done for this!
So you were sat at the lights turning right????
Even if you were on your phone, you were stationery & he was moving!!!
I had a faulse claim against me for whiplash in an accident 2 years ago, she wasn\'t wareing a belt although I couldn\'t prove it & the dent in the back of the car was the size of a small football!!
Go screw the lieing git for everything you can!! & it is an offence to leave the scene as it happend to a mate of mine.... new driver didn\'t know what to do so she ran home abandoning the car, came back with her pairents just after the poilce turned up, bang 3 points on your new licence, now go resit your test again!!
Jono
P.S. this wasn\'t the RX7.5 was it??
Yes I thought that him leaving the scene would be an offence, but when we were at the police station the policewoman said that as he\'d rang the police to say he\'d been involved in an accident, he\'d done the right thing, even though he didn\'t stop?!
Hi Alison,
Really sorry to hear about this - I hope you get it sorted.
I think you\'d be wasting your time with Orange - firsly yes you are entitled to copies of any information they have about you but only if it\'s in an easily accessable format. As Bobbit says - if you don\'t have itemised billing this may not be very easy to do. And secondly it won\'t 100% prove you weren\'t on the phone - as said it could have been an incomming call and you wiped the record, or you could have been on another phone - I have two.
Anyway it sounds to me like he\'s just trying it on so stick to your guns and I\'m sure you\'ll be fine. The damage should also hopefully show that he hit you?
Anyway good luck and let us know what happens.

Well what if he was over the limit! that\'s a crafty move! to protect his license! i still think he should be prosecuted for leaving the scene of an accident, i am suprised the insurance co, have taken the car away! i thought they sent an accessor to the car!
Good luck Alison.
Well they told me they were taking it away but the guy came this morning and just took some photos. I\'ll be getting the dreaded phone call either later today or tomorrow!
This may sound a bit of a daft suggestion, but at the moment the Insurance companies we work with are trying very hard not to write cars off if they can absolutely help it, last week we repaired a 89 Supra with similar damage because the guy who owned the car spoke to the Assessor and suggested he supply second hand panels which dramatically reduced the cost of the repair, Don\'t feel that you can\'t suggest options like this if you don\'t want your car totaled as its often the price of Panels that send things like Fd\'s over the edge (the front end is mainly bolt on bits so little labour involved).

Unfortunately the police think more like this now (example) Imagen you want to car jack some one?? whats the easiest way to get them to pull over and get out of the car?? or the road rage Theory, to avoid things escalating into an assault or serious incident if for example you feel threatened.
So the police\'s response can be very different depending on how you respond after you drive away and the words you use when you talk to them.
But in your case i think the Guy\'s obviously not new to all this (proberly is a coward who doesn\'t like to front the person who\'s property he\'s damaged).
Thanks for the replies guys, here\'s some pictures of my baby...

Jings! He didn\'t exactly just graze you, then, did he! Must\'ve been quite a whack, can\'t believe someone could be so maggot-c*cked to hit someone that hard and just drive off. He was probably hoping you didn\'t get his number, so he\'d "done the right thing" according to the Bill by phoning them, but no-one had come forward to claim against him (due to not knowing who the scumbag was), so it just gets dropped. The sickening lowlife!
tbh that looks an easy repair (not too far of a diy job). Not a very good pic of the Bumper (may repair) and replace the wing and possably lamp cover if its damaged and not just come off its brackets.
Have you got a pic of the front panel with the bonnet open? the light looks a funny angle but i don\'t see anything that is hard to fix (may be an illusion with the wing being pulled out)

i was thinking that myself, does look very conmetic, new bumper, wing etc and sorted :)
Yeah hopefully not as drastic as we first thought!!
Got a local bodyshop out to give a proper estimate so waiting for that, should be tomorrow now.
Probably needs the whole headlight unit replacing, and like you say, new wing, bumper...jobs a good \'un!!
sorry to see that alison
but looks an easy fix as long as its done no damage under bonnet
leaving the scene is a big no-no - is it worth speaking to the old bill again and seeing what they say? As far as i am aware, if anyone is injured the police are obliged to attend accidents too.
a) he could have been drunk
b) the chap driving might not be the insured driver/banned etc, and the chap that phoned up might be the real insured party.
what a pita, sorry for you.
I would say as he didn\'t stop it is almost certain that one of the above was true.
It\'s five to ten points discretionary for leaving the scene OR failing to report an accident, I believe. Unfortunately, the ol Bill are now so stretched/lazy/incompetent (delete as applicable, depending on how hostile you feel towards our boys in blue atm), they settle for the culprit just reporting it if they do leave the scene, a sort of deliberate misunderstanding of a bit of woolly wording of the law that lets them spend more time eating doughnuts and eying up porn at the station/call centre/sty (delete as applicable, you get the idea).

Yes I\'m pretty sure one of these is true too, \'cause when my boyfriend spoke to the person on the phone that night the supposed drivers dad answered and wouldn\'t let my boyfriend talk to the son!! Dodgy or what?
I think i would approach the Police again, The driver of the van crashes in to you, leaves the scene without knowing if you had been injured! (you could still be suffering from whiplash! as said he could have been drunk! covering for someone else! or wanting to get his van repaired, paid for by your insurance! who knows, he has already got you on the defensive by thinking about prooving that you were not using a phone! it is unforgivable that the police accept what the guy is saying without questioning him as to why he did not stop! i see thier inactivity as supporting the van driver. Had you been able to phone the Police to tell them a van crashed into you and drove off, perhaps it would be different! all very well in hindsight i know.
The car does look repairable, as others have said, personally i would do it myself without involving insurance, Hope all sorts out for you.

You make a good point, but I suppose the police wouldn\'t want to know now the accident has happened and all this time has passed?
Quotebut I suppose the police wouldn\'t want to know now the accident has happened and all this time has passed?
They didnt want to know in the first place! The van driver broke the law by not stopping! Sure it may not be convenient for them to have you complaning to them again! but had they done thier job it would not be necessary for you to contact them again, The fact that the guy with a damaged van has not been followed up by the police, he will believe he has got away with it, no repercusions at all! with the police excluding themselves by not doing thier duty, and allowing the van driver to get away with leaving the scene of an accident, it\'s then between you and the van driver! how much more encouragement would he need to claim off your insurance for the damage to his van! sorry to go on, but personally i would complain to the police again, wether they like it or not! if only to get ahead of the game the van driver maybe playing! and for the welfare of anyone else the van driver may crash in to, (which may be why he didnt stop this time!)
:rollin :2eek I spoke to Mazda yesterday - they told the garage that my chassis number was wrong so I wanted to check it - and thought I\'d just ask about the front bumper while I was there!! £740 + VAT. And there\'s none in the country so they have no idea when one could be delivered, he even said it could take up to 12 months. Lol have to laugh or I\'d cry. Be easier to get an aftermarket one!
hi Alison. Its andy from six hills jap mids. If u want the wing ur more than welcome 2it. Its got a bit of a scratch n sum paint chipped but thats it. Sat in my garage collecting dust. No cost as I\'ll b glad 2c it gone.
Hi Alison,
Sorry I have managed to miss this thread until now, doh
Really sorry to hear you have had all this agro, but very pleased to hear that you have just had a kind offer of a wing from one of our members
(aeseaton).
I can tell you that the Mazda dealer for whatever has the parts thing wrong as almost any part can be obtained in 6 weeks if it has to come from Japan with parts like yours that cross over to a U/K available normally in around 10 days or less, also their price seems very high as from memory nose cones are around £450 plus vat
Have you now got somewhere with the claim ?
Yes, the cars now in the garage, Gary at Rotaryart is kindly sorting all the parts for us so hopefully it will be ready in the not too distant future!!
Thanks for the offer of that wing BTW, if we need it/have any problems with getting one, I\'ll let you know!! :)
