£60 fine for not being in full control

Sarnie almost as bad...?Eating a cheese and pickle sandwich while driving resulted in motorist Keith Pemberton being pulled over and booked by police officers at a roadside checkpoint on the A49 in Cheshire.

He was fined £60 and got three points on his licence after being convicted of not being in full control of the car.

Pemberton told the BBC: "They said I had not been in proper control of my car, but it\'s not as if I was swerving all over the road or driving badly."

The Cheshire police said: "The officer was right to give this driver a ticket. He cannot have had full control of his vehicle if he was eating a sandwich at the same time."

Road safety campaign Safe Speed said: "Cases like this illustrate the gulf between official and real road safety. It is vital that drivers are in proper control of their vehicles, but proper control is a state of mind, not a simple matter of what drivers are doing with their hands.

"The problem is that driving is largely a subconscious and highly skilled activity. The authorities can\'t see it or define it, so instead they seize upon what they can see.

"Eating a sandwich while driving can be safe or dangerous. It depends on the circumstances and what the driver is paying attention to.

"Road safety is in a very bad way - the authorities need to move away from their over-simplified dogma and start asking skilled drivers what is safe and what is not. The gap is enormous."

I still say (and I didn\'t know Jeremy Clarkson holds the same view) that if you don\'t pass your test in the first 3 goes, you don\'t get to drive. If you have a license in another country then you need to re-sit it in this country. once you get past 60, you need to take it again.

You\'ll cut the traffic down, you\'ll make more people use public transport, the o-zone layer and all that won\'t be melted (or whatever :2Rolleyes so that keeps the government happy) we can have a little more faith in the people we share our roads with, driving will be a privilige not a requirment....and they better do this soon as it\'s certainly not getting ANY better out there....

Oh and maybe there should be a RULE that people should spend at least one year on a motorbike to improve road awarness.....not to sit at a computer and click a p0xy little mouse....

THEN MAYBE THE POLICE CAN ACTUALLY GO OUT AND DO THEIR JOB INSTEAD ON PICKING ON MOTORISTS FOR AN EASY LIFE.....

Yikes! Everybody with a manual shift I bet now are papping themselves me included, coz every time I change gear, I guess I\'m not in full control!?

Remember watching the Traffic Cops programme on BBC a while back...in 1 scene, copper pulls a bloke over for using his mobile and gave him a right lecture...moments later you\'re watching the police in a high speed pursuit on a housing estate and he\'s giving a running commentary to base on an old style hand held phone! :2Rolleyes

I got 3 point and a £60 fine the other day.  I was travelling along a quiet road in my town at 11:30pm.  My wife rang me, and although stupid of me to pick my phone up, my conversation consisted of i\'ll be home in two minutes then put the phone down.  But in the time that it took me to do that I had flashing lights in my rear view mirror half a mile down the road.

When I questioned him where he saw me, he said i\'ve been parked down a side street all night when you passed me.....??  So obviously a highly productive night for him.

Anyway what really got to me was going to the police station to do a producer.  I was sat in a room filled with scallies, one who was sat next to me, who got an £80 fine and a slap of the wrists for threatening somebody with a crow bar then proceeded to smash up the insides of their house with the crow bar.

When I questioned the copper to say how can you justify giving me a £60 and 3 points which is probably going to bump up my insurance more than the fine, yet that little pr1ck gets an £80 fine and a slap for doing all that??

His response was, well you could of killed someone!!??!!  Lets look at it this way ok I was silly answering my phone, but in my defence it was:

1.) 11:30pm at night on a week day
2.) Very quiet stretch of road with full visability
3.) My phone call was a total of about 3 seconds to my slightly worried wife

Yet a scally gets in the long run probably less for threats of physical violence and acts criminal damage!!??

I suppose the one big difference is that the scally doesnt have any papers, doesnt pay thousands a year for taxes and insurances so not as easy to do him.

Im beging to hate this country & labour government more and more and I dread to think what state it\'s going to be in when my son is my age!

I got £60 and three points for doing 82mph on a dual carriageway (70mph limit) on a dry, sunny Sunday afternoon with no other traffic in sight.

I was less than impressed.

Though, I had been doing over a ton a few minutes earlier so it could have been  worse.

I damn well can complain.

The point of speeding is that it is only about speed, and has nothing to do with whether you are driving like a nob or not.
I could have been within the speed limit in wet weather, poor visibility and heavy traffic and genuinely been putting myself and others at risk yet not be fined for it.

So yeah, doing 80 in the dry warm weather with plenty of room I feel annoyed at being booked for supposedly dangerous driving.

Well, you knew the rules of the road, and the law governing speed limits, so you can\'t complain. Until the day where we are given personnal speed limits, that are adjusted by our age, car being driven, weather we\'re driving in, road conditions, then static speed will be used and you can\'t really complain about getting fined for it.

arg! That was directed at teabagger, not the first post.

The conviction governing the first post is truely madness (And can now happen due to the new laws created to combat drivers talking on their mobile phones)

I can, and I will. Furthermore, I seriously doubt you stick to the speed limit all the time so not sure where you\'ve got your high horse from.

And how do you rationalise driving along one handed while eating a sandwich to be less of a danger than doing 12mph over the limit in perfect driving conditions? You can\'t pull the "it\'s the law" argument with one and not the other.

Yeah, i\'ve been convicted twice for speeding. And, no, i\'m no angel (ALthough I do stick to speed limits in built up areas). I am also not on any \'high horse\', just merely commenting that you can\'t complain, cos it\'s a fair cop. I never complained when i got caught - i was speeding. Fair play.

I\'ve also had a car towed, didn\'t complain about that even though realistically, it was not in anyones field of vision. I was on white zig-zaggy lines, and therefore I can\'t comaplain.

I\'m also bored at work, and trying to pass the time! :p

Unfortunately not.  Using a mobile while driving is, like speeding, an absolute offence.  You either were or weren\'t.  The only relevant mitigation is in the sentencing and you\'d have to risk going to court and facing a stiffer punishment than a paedophile.

I have to agree with teabagger....

Doing 12mph on a hot day is far less serious than doing 70mph on a pi$$ing down motorway where you can\'t see 5ft infront let alone 50!

It\'s like having a the national speed limit on tiny country roads where you\'d be mad to try and stick at them.

Realistic speeds for motorways and the like.

Now to put the rest of the world to rights.....Conservatives should be back in power as they were finally getting to grips with things when Labour bribed the millions of people on benefits to vote for them.

Should take a leaf out of ALI-G\'s book and only let "fit" imigrants in.

If you want to have a house, 50 kids and drink all day, go out and EARN YOU\'RE OWN FCUKING MONEY AND STOP MAKING IT HARD FOR THE PEOPLE THAT DO GET UP EARLY AND WORK THEIR AR$ES OFF TO LIVE.

I\'m going to get some badges made up for the next election, get every rex in the country to block Westminster, bring London to a stand still and get a front seat in parlament whilst the rest can sit at the back occasionally saying "here here" and "zzzzzzzz" and give some backbone to the once Great Britian....

You\'ve got to remember that speed limit were only introduced due to the petrol crisi in the 70\'s...

...OK, things are busier now so there needs to be something but yeah, doing 70 in torrential rain is just mental.

And I heard in some countries if you fail you driving test 3 times then you have to have a psychiatric evaluation to see if you\'re mentally fit to be in control of a 2 ton lump of speeding metal! Perfect idea if you ask me :D

Then again, I\'d probably fail most tests now, other than an ARDS.

LOL, I think they should make it a national lottery. When somebody passes their license back to the DVLA somebody else gets the chance to learn to drive. This would remove the increases in congestion because the same amount of drivers stay on the road !!!

The world has gone mad....

Whats the difference with chatting on the phone while driving and chatting with a passenger next to you or in the back seats??????
The distraction is worse with a passenger as you would be driving, chatting and looking at them while conversing...
Children will be banned from riding in cars!
May as well Ban playing a stereo in the car too... as you\'ll be caught up \'distracted\' by trying to sing along or listening to Chris Moyles talk ****e!
Suppose changing gear will be frowned upon also... talking your hands off the wheel to change gear.. you bad dangerous driver!

Next on the list you\'ll have to pull into a Services to scratch your b0llocks when you get an itch as that will be distracting using one hand on the wheel...

.
SO the cars of the future will be designed for 1 person only and no Stereo\'s, nav aids, no gear sticks, and tight pants is a must when driving!

i dunno lads

eating a sarnie while driving along isnt easy you would have to drive with one hand. people who smoke n drive at the same time have two hands on the wheel cos the fag is in thier gob. the reason they dont let you use a mobile while driving is because you dont have two hands on the steering wheel, what if you had to swerve to avoid an obsticle?

Id rather stop and eat properly, theres no way i could tackle a foot long subway while driving esp as the contents of a sarnie always ends up in your lap and if your trying to eat while driving an rx - tis much easier to drive a narrow windy country road at national speed limits....
Title: Only one hand

Are so: does this mean, anyone who ever takes their hand off the wheel for a second is not in full control of their car? SO where do you draw the line then. No listening to your fav music, not giving the road your full attention. !!! Come on, You can\'t treat everyone like a complete idiot!

the policeman could have given him a warning. but perhaps the guy was rude to them so he booked him?

all im saying is - why bother with the fag in one hand phone in the other mentality when you can just drive more safely using both hands and then stop and eat properly later?

Yea but the this person was not driving in a manner which would indicate that they were NOT in control. I think  the main point is! It\'s what they said could have happened, not what did happen! which was nothing. I feel the point is this opens the flood gates to all sorts of stupid logic, as mentioned earlier. wer do you draw the line. It\'s a Police state, and people are  Are legislative prisoners or state slaves. That’s were this has gone. There’s no room for personal responsibility anymore.

You don\'t motorcyclists get away with wheelying because nothing did happen. No, they get stopped because it\'s dangerous and something could (And most likely will) happen.

But I\'ve eaten sarnies, or pasties (mmm ginsters!) loads and loads on motorway journeys. Same as having a swig of drink from a bottle, you\'re telling me you shouldn\'t take anything to drink when driving a couple of hours somewhere???

But if you put the triangle part down between your legs, you can take a bite, put the sarnie back and happily drive along :D Sure a footlong with extra filling would be somewhat tricky!

Still, with this story we\'re missing what road he was on, what the weather was like etc...

No, wasn\'t saying that at all: I think being clocked for eating is as ridiculous as everyone else. But some people are joining the bandwagon and complaining about speeding tickets, etc, etc. A society has got to have rules, otherwise it anarchy. If we don\'t like those rules, then campaign to get them changed, as opposed to complain about them and do nothing. :)

It\'s nothing to do with being a bandwagon. It\'s about objecting to being prosecuted on the pretence that you are endangering others when it clearly has nothing to do with that.

And you still haven\'t justified how you think eating is less dangerous than doing 80mph in the conditions I described earlier... Your argument is totally hypocritical, if \'a society has got to have rules\' as you say then surely you should be against eating at the wheel on the very principle you yourself have just laid down.

I know im going against the grain - how i see it -  perhaps they hit a bump and then it went all over thier lap - then they were looking down and then crash!!!

you would be gutted if the reason someone went into the back of you was because they were eating something

Its easy to say "nothing happened so no foul" but when it does happen say the same thing happened and they killed someone?

Its just not worth it, with the amount of people on the road these days, you cant divert attention for a second.

I suppose that your right we do live in a bit of a nanny state these days, but its probably safer... this is why i can see where the officer was coming from - as always with these stories you dont actually know the full story! so maybe he was weaving all over - didnt admit it to a newspaper?!

Surely the point is they can only do you for what can be seen.
So unless you\'re pulling a moonie out the window whilst scratching your bits you\'re not going to get done!

This guy was eating a sarnie in plain view of a copper so obviously wasn\'t paying full attention to the road or he would have seen the flaming copper in the first place!!!! :D

Roads are getting more dangerous and so the police have to do something.

If something happened lets say, to one of our cars and the driver was having a swig of his milk as he crashed into it we would all be the first ones to jump on this forum and complain that he wasn\'t concentrating on the road!

The problem seems to be that everybody thinks that their life is the most important, so rather than pulling over to eat for 5 mins in this case he just figured, "oh well I\'m hungry what is the worst that could happen?"
Some of you seem to think the worst is that he got fined, but what if he spilt the thing looked down and hit someone??????:(

Can\'t Poilice everything like radio, passengers etc but lets face it wouldn\'t the roads  be safer if they did?

82 mph on a motorway is illegal. But so is stealing my laptop from my luggage. The police fine us for going fast ( when it was safe), but they dont care when you have £1000 plus laptop stolen.

So we have this picture that Kev, who went 82, is FAR more of a criminal that the tw4t who stole my laptop. Thats UNREASONABLE.

Don\'t get me wrong I know that the motorist is an easy target.
But getting your laptop knicked is not going to potentially kill someone is it??
82 in a 70 is only safe if a compitent driver in a modern car is doing it and how can the police know who is a good driver. After all, the only thing they have to go on in that moment that they saw you is that you speed! Now from their way of thinking does that mean that you (not you specifically) also speed past schools at 330pm???
Therfore this is potentially dangerous and could kill someone.
Then what is better? The guy knicking your laptop or the driver that chose the wrong time to speed and killed a family???

Again only my 2p worth (so that makes 4p now :D)

Well, lets change my argument a little then. So its about safety, is it?

So, its ok then, to :
not signal at roundabouts,
drive right up the back of the preceding vehicle at 70,
change lanes without signalling,
have a dog in the car,
cross the road aywhere you like ( when there is a pedestrian crossing 10 metres away ),
Not stop at red lights if you\'re on a bicycle,

etc, etc, (you get what I mean)

Why dont the fuzz care about any of that? We see this every day, all of us who drive.

We agree on your first statement, the motorist is an easy (money making) target. All I have to do is set up a camera, in the NAME of safety, and watch the bucks roll in.

Actually, stealing a Laptop COULD kill someone, I would be tempted to kill the tw4t who stole it if I ever found him !! :-)

As for the others, tailgating, having a dog in the car (not harnessed or in a cage) and bicycles running red lights are dangerous and illegal and so if the police did spot this they would get fined / cautioned.
The others on your list are anoying but not dangerous and so would not get fined / cautioned.
All about safety :D

But the problem we have is that the police are NOT fining/cautioning these other offences nearly as much as nicking people 12mph over the speed limit and the like.....and to me they are much more dangerous to be brutally honest.

I don\'t condone driving at speeds outside schools etc nowever I don\'t agree with nit-pick-nicking either.....

They can\'t fine / caution everybody\'s driving issues they would need thousands more officers.

Lets face it how many times have we all been guilty of speeding and not been caught?????? We just don\'t complain about that do we?
"Bloody police I was doing 90 in a 60 and I didn\'t even get fined!!!!!" :D

D1 daddy sees my point. if its in the interest of safety, why dont they fine for this other stuff (as often as they do for speeding).

Lets ask this " is it more dangerous to go fast around a corner or on a straight?"

Obviously on a corner... so... have you ever seen a camera on a corner?

Luckily for me, I havent! Its MUCH more fun to go fast around a corner ( and requires skill), than on a straight.

:-)))))))))))))))))

Again:

No-one has used this example because, quite rightly, doing 90 in a 60 is a bit OTT.....

Getting done for 12mph over the 70mph limit on a clear road is just nit-picking. Unfortunately it\'s never going to be clear cut.....you\'re saying wrong is wrong but what we\'re saying is there seems to be a massive grey area where the Police seem to be getting that wrong.

Please don\'t think i\'m saying i\'m a golden boy.....I pretty much rag it whenever I get the chance but two things you gain with getting a high performance car....

1) You realise the more BHP you get, the more braking you do :Laugh
and
2) You get fcuking good at spotting the white and blues

I\'m shocked every day by the standards of driving on the roads. But it\'s the little things that wind me up cos I see them every few hundred yards on the way to and from work... Mostly little things like indicating right at a roundabout to go straight on, or slamming on and pulling over with no signal, straight lining dual carriageway roundabouts, pulling out in front of traffic, people right up my arse (although a blip and a flame generally sorts that out) having dogs running side to side on the parcel shelf, make-up in the mirror, texting, reading, rustling around for a good 10 seconds to find a CD in their glovebox! My boss picked me up the other morning with a mug of tea and a plate of cheese on toast!!!

As far as speed on motorways goes... The way I se it is that inappropriate speed works both ways. The amount of times I\'ve seen people going WAY TOO SLOW! Monday night, prime example, on the way back from the North West meet i was in the left lane of the motorway coming up to my turn off, the car in front was obviously going slower than me. At this poiint I was winding down for the turn off, probably doing about 65-70 noticed i was still going considerably faster than the car in front. I brake, brake some more and some more... The car was a 2-3yr old clio and was doing 40-45 on the M6! That is in my view A LOT more dangerous than 82mph!

If i had any say in such things I\'d introduce a minimum speed limit of 60 and a maximim of 80, this way the diference would only ever be 20mph so the motorway would be a far safer place. Police would then be able to charge people for driving excessively over or below the speed limits.

I dont think the limits should necessarily be raised as there are a lot of cars out there that even in this modern day are not REALLY safe at 90mph... And as for the drivers...

That\'s a whole seperate rant, I reckon you should have to re-take your test every 10 years or so. They should give you a grade A B C D E, higher grade means better driver so cheaper insurance! Lower grade means you probably cant handle a faster car, if you want to re-take and get a better grade so be it...

Also I think you should have compulsary night driving and motorway driving as part of the test. And before anyone says no way should we have learners on the motorway, think about it, I\'d rather they were supervised the first time they ventured onto the motorway than going on ten minutes after passing their test (with no previous experience and un supervised)...

Rant over :D

Bloody hell I just realised - I\'m a grumpy old man...

For the record I\'m 24 with a clean license, don\'t smoke and don\'t use my mobile ever when driving :) And to be honest i wuoldn\'t eat a butty either but that\'s more down to not wanting to get my seats grubby :p

In summary, we need a BALANCED approach by th police to whats Legal, and whats safe.

I think we agree on here that we dont have that.
