Driving home - doing circa 40 along a normal road. Cars queueing in opposite direction, road clear in my direction. Around a right hand bend some dude pulls out of a turning (he was on my right, turning right to go the same direction as me) and comes straight into my lane without even looking...i swerved to avoid, had to go up a curb but he still hit me and scraped down the right hand side of my car.

So ive gotta get two wheels refurbed and the side of the car blown over/resprayed.

idiot!! Not worth claiming on insurance anyway, damage is only about 400 worth and my premium will go up more than that with a claim.

Yeah we stopped, exchanged details. The guy was very apologetic and said he felt terrible but said he cannot afford to give me anything, we would have to go through insurance and go our separate ways - he says he\'s just separated from his wife and has a new mortgage bla bla bla. I might call him a bit later and tell him how much its going to cost....theres no damage to his car at all so...

Still a pain in the arse. Repair to the wheels is booked in for thursday, and the door ill probably do myself.

oh no!! :( :( really sorry to see that mate :( atleast get him to pay for the refurb on those wheels...they cost a bomb!! :(

Bad luck, those wheels are beautiful, hope they come up good again.  

You can make a 3rd party claim straight from his insurance.  A few years back I had someone run into my saxo and dented my wing.  I didnt want to make a claim through my insurance because with the young driver excess etc I would have had to fork out £600 and I knew I could have it repaired for £150.  So I used the free legal services with my insurance to go about getting my money back after having it repaired.  It did take some time because the other person was denying lability, but in the end I got back my costs plus a bit more ;) for the trouble.

Stupid thing was, over £2000 was spent on legal costs, solicitors etc just to get my £150;)  back

Sorry for you mate. Doesn\'t sound like you\'re going to get anything out of him without threatening to break his kneecaps though.

Did you get any independant witness to what happened?

There are some idiots on the road. I had a van pull straight out into the side of mine last week!!!!!! So gotta have the door replaced. It\'s going through the insurance though, as it\'s entirely his fault. So it won\'t affect my no claims.
 
Surely that\'s the same for you on the insurance? It wasn\'t your fault.

Who cares a toss about his life..........they all got this lil speech,no money,divorced,ex wife is taking all his money........who cares bro.He knows you have to calim cos of the car you drive !!.........he could not care less about his ****ty car,its just a medium for him.:spank Most probs bragging with his mates how he has got no damage and you car is stuffed !!!!!!!!!!!!You were far to kind to him....:confused:

i am in st.albans, who you getting to refurb the wheels, as i need the two on my left hand side done.  (the previous owner (of the wheels) missus must have driven the car. only joking)

Not very often i say this but .................... i agree with Era here, not your problem as to the dudes personal probs, he hit your car get him to pay for it mate !!!

Put it this way if you had hit someone would they be as understanding ??? or would they bring the neck pains and feel dizzy crap into it ?? think about it ???

Also where theres blame theres a claim ???? sad to say but others would :o

For people that love their cars and love driving what would you think about resitting your test every 3 years or so?

I spend a lot of the time on the road and see poor driving all day long. I think having to resit often would raise the standard and get the nobheads of the road.

Uk drivers are stunning! even the crap ones compaired to 99% in Bulgaria, these ladies all have a death wish out here

I\'m so fed up of muppets. I\'ve had three non-fault accidents in just over a year. The 1st one was some boy racer **** trying to catch an evo in his s13 and ended up running into me and driving off. Lucky he was caught up with but he\'s still denying liability with three witnesses on my side. The next accident some old guy came screaming onto a roundabout and took the front end of my car off. The last accident just over a week ago was some silly phucking old bint straight lining a roundabout and smashed into the back of me.... she got out and blamed me of driving too quick!!! she went into the back of me! Go figure that one out. Silly cow hasn\'t reported the accident and it looks like she is denying it happened.

I\'d be tempted to claim off him if he is willing to admit liability. Only does it become a head ache if they deny it.

He was a mild mannered oldish chap - id say early to mid 50\'s. Fact was there are no witnesses and i was going a little fast (about 40 in a 30, is the honest truth) so that makes things more difficult.

To be honest, the cars off the road anyway for the winter now and i plan to respray it anyway as the paints terrible, so all claiming on the insurance is going to do is save me 150 getting my wheels refurbed. Thats it. So im not too bothered really, cant be arsed with the hassle.

fvck the "hassle factor" mate. He\'s hit your car, get his details and claim on his insurance. Yours don\'t even have to know about it. Also, speed doesn\'t come into it. He should have seen you no matter what speed you were doing. When it happened to me I made sure that I specified which body shop it would go to and then spoke to them to get all the little dings sorted while it was there. His insurance company stumped up for the main repair, I paid the extra to have the little bits done. Everyone\'s a winner (apart from the dozy git that hit my car).

As has been said above,  it\'s not your fault, why should you pay anything to get it fixed.

Of course my insurance need to know. My insurance is invalid if i don\'t tell them about any accidents regardless of fault. Yes he should have seen me and it was his fault for pulling out on me, but for the sake of 150 quid im not risking having my insurance price go up. MY insurance is expensive enough as it is! Admiral want 2800 to insure me fully comp with 4 years NCB and no claims and i want to go fully comp soon so im NOT having an accident on my record!

try noel dazley mate, im same age as you with 2 yrs ncb, 4 years driving and it was £1700 for me fully comp with alloys and air filter declared.

Sorry to hear it ... and i see muppets on the road every day and a re test ever 3 years is ok with me .

I would claim off his insurance as this is a non fault claim and your insurance will enjoy the extra money lol
