Title: Highway Insurance have finally settled my claim
Post by: BlitzBoy on July 25, 2006, 10:11:48 AM
Well just found out my so called insurance policy is not worth the paper its printed on!
Saying they will not payout on mechanical failure of the fuel pipe.
Im gutted !!!

they also went on to say I had Nitrous fitted!!! I mean WTF!! they are saying their trained Engineer found a T piece on the fuel pipe indicates a fuel boosting system!!! never used nitrous in my life!!!

They also they have been on this Forum found out my forum name and found some interesting posts about racing and such like, so FFFing what!. I mean WTF has that got to do with a fire claim!!!

I did everything by the book declared my mods and stuff.

Guys and Girls, I advise you unless you have a complete standard car not to bother with fully comp.

I will be insuring Third party only from now on

Now I need to get my car back and break it for parts to get some money back

That seems outrageous.

Surely if you pay for fully comp insurance then it should cover every eventuality??

Which insurer was it??

that is disgraceful...absolutely disgusting behaviour....surely if you have declared everything on the car they must payout? especially so on a fc policy!

Post by: sadgoth on July 25, 2006, 10:25:23 AM
take it to the insurance ombudsman (spelling), you have been paying a higher premium to cover the fact that you were running a modified car, therefore you have paid for the additional risk. Surely the onus is on them to prove that you have not adhered to the policy. If you have raced the car, fine, you aren\'t covered DURING that event, you are still covered on the road.
Title: Highway Insurance have finally settled my claim
Post by: nikp on July 25, 2006, 10:28:10 AM
Before you go to the insurance ombudsman, you need to take it through their complaints department - that\'s all the ombudsman will say first anyway. All insurance companies will have a complaints department. A friend of mine had to do this, and they did get somewhere with the process.

That\'s just terrible and shocking behaviour.

Well I have just had enough of it all, they delayed me me for two months, and basically made me sound like a dirty fraudster, the only thing I did wrong was not admitting on the phone that I drag race at pod and them later finding out I do.

Im just want my car back I have 7K sitting underneath the hood undamaged

HIGHWAY INSURANCE you suck!

Cant be dealing with complaints procedure and stuff its all to stressfull

No way, elephant tried to get out of paying me.

And worst of all i have just got insured with highway, Really thinking about ringing them up and telling them where to stick it and why
Title: Highway Insurance have finally settled my claim
Post by: BlitzBoy on July 25, 2006, 10:45:17 AM
yes mate the guy dealing with my claim at highway used every trick in the book to make me say something on the telephone statement so he could use this against me. He was so friendly on the phone as well, their job is just basically to try small print in the policy and not to pay.

Also during the peroid of the two months of the claim, they never wrote to me or phoned me. It was basically me ringing them and chasing them all the time, their customer service sucks!!

I mean imagine not paying out on a fully comp insurance due to mechanical failure, fully comp is suppossed to be just that Fully comp!

But be warned guys insurnace companies read our threads, so if you write anything they will use it against us.
Title: Highway Insurance have finally settled my claim
Post by: Jit on July 25, 2006, 10:48:38 AM
were they using the fact that you were driving to a supposed race event against you or the fact that you race the car period?
Title: Highway Insurance have finally settled my claim
Post by: BlitzBoy on July 25, 2006, 10:53:39 AM
No they are using the fact I "said" I was not going to race when in fact I was going to, against me indicating im a liar in not so many words.

But this was just added on at the end of the letter (for what reason I dont know other then to make me feel like a low life), the reason they are not paying because of mechanical failure of the fuel line at the end of the day

They\'re not paying out due to mechanical failure?

So if a tyre blew out and you crashed into a tree as a result they wouldn\'t pay out either?

Do they mention this in the conditions of insurance?
Title: Highway Insurance have finally settled my claim
Post by: BlitzBoy on July 25, 2006, 11:09:16 AM
Fro

You are quite correct, they do mention some mechanical failure blah blah in the small print of checking, but obviously I could fight this and eventually win but we are talking months maybe a year for this kind of process, all the while my old car is lying in a recovery yard.
I just dont want the stress anymore. Gonna get my car back then talk to Reworx about swapping the engine/turbo plus bits into my new car and sell my T04R and mild ported engine on the forum

Mark, you\'re right - you could eventually win that case but it would be a drawn out procedure. I hope you\'re able to recover the car ok.

I\'ll be avoiding highway insurance like the plague from now on. This isn\'t good publicity for them and I hope they reconsider

well check this the Craig Hammond I dealt with at Highway Insurance was so nice as pie on the phone to me when he took my statement, saying he is car enthusiast himself saying he is part of the Morris Minor Car club, I hope his car catches fire lets see how he likes it when he tries to claim and being j£rked around for two months and lied to as well!

Also the coward drafted the letter on the Friday sent it knowing he is on holiday now ! spineless, he should have been a man and told me on the phone

Sorry to hear about your insurance Mark.  If you can\'t be asked to go through the complaint process then just get the car back and sell for parts.

When i had 2 crashes and written both of the fds off, i just bit the bullet and did not go through insurance as they will look for any excuse for not to pay you.  I made some money back by selling bits and that was it.

I hope you get it all sorted as i know what you are going through.  Get the car back of them ASAP and see what is left for us all.....lol only kidding bud.

May see you at TOTB.

Thats absolutely disgusting.  We need to make sure no one else in the car enthusiaast community fall foul to this cowboy outfit.  Perhaps a drafted email/thread - posted on every car forum we can find, or are a member of, to warn people?  As well as doing people a favour it help to make you feel better that you could cost them the cost of this claim and then some in lost premiums!!

Sorry for you mate - i\'m sure it will all work out in the end - your new car is a beauty, and with you old cars engine!!!....  well say no more.

Cheers Mark.

I wonder if we can get one of the mods to make this a sticky.

Also I think it serves as a warning that telephone statements are designed to work against you , I told one white lie and they have branded me a fraudster even though me taking the car up the strip has nothing to do with the claim

Gutted for you Mark. I\'d say bite the bullet and get your car back so you can get the engine etc while it is still in a useable condition. I know you shouldn\'t have to do this, but I think it is the only way to get what good is left of the bad.

Sorry again,

That is unbelievable.....Can understand how you can\'t be bothered with the hassle of fighting it but, really they shouldn\'t be able to get away with that kind of behaviour. It is a legal requirement to be insured so we have no choice there....But insurance companies can just decide whether to pay out or not, based on the smallest technicality, it really stinks....Makes you wonder how many of us in the club actually have insurance worth the paper its written on.

I find it strange that they wont pay out,  if the car was stock and a fuel hose split, they would have paid.  You told them about the mods so they are aware and should cover.

I also cant understand what difference it makes where you were going.  The policy states that you are not insured to race etc etc, which is fine, you dont expect cover while on the strip but this clearly didnt happen on the strip.  Are they of the opinion that this occured on the strip??  You have photos to prove not!  Are they saying that you are not permitted to use the car for any kind of racing?

The car is your property still, and you can do what you like with it.  Get the car and crack on but still fight with the company and if you win they will just deduct the value of the salvage from the final payout.

Good luck

TBH [this won\'t go down well] If i did run an insurance company I wouldn\'t want to insure under 25\'s on a rex - better off insuring little old ladies in micras.

On a similar note.. .

I wrote off a 10 year old CRX a few years back and got offered about £1500.

I kicked up a hell of a fuss as I\'d paid something like £3700 for it 6 months earlier as I had a bill from the previous owner for a complete engine rebuild by Honda. After a bit of to-ing and fro-ing I got £3500 from them.

It might be worth pushing them.

Just spoke to Hyperformance who have insured me with highway, They say that highway are backed by lloyds so most insurance companies are the same.

Bloke on the phone could not understand why i would want to move my policy! he was just reading from his sheet in front of him,

I said am i covered if im driving up the road and my car bursts into flames,

Well err no, not if it wasnt vandalism or robbery.

But this is total rubbish cos i have seen countless lorrys and cars on fire on the M25 and never heard of them not paying out.

I think this case needs to be made an example of like the police do to us.

They cant be let to get away with it, Other wise why do we need insurance!!!!

Oh i forgot, to pay for all those fraudsters claiming whiplash

This made me so angry - it seems to me that so many of these companies will try it on and hope that you back down. I called my dad who spend 41 years working in the city on motor policy for a major insurer. His suggestion was:

1) Take legal advice. Confirm whether there are any specific exclusions in the policy. Most policies exclude mechanical failure, but you need to check whether there are any specific exclusions for consequential damage. The expectation is that they could reasonably refuse to pay for the replacement of a faulty hose, but would be liable for the fire damage that resulted.

2) Write to the general manager stating why you feel the claim is valid.

3) If the claim is still refused, take it to the insurance onbudsman.

4) Check whether you have cover for legal costs. You may be able to use this to cover your case against them!

Hope this helps

Keith

just read this thread. WTF?? I know insurance companies are robbing barstewards but this is taking the p1ss. I would agree with the others advising legal action, but i know what it\'s like when you need your car back. I had hastle with my first car, some little turd set it on fire. the insurance company refused to pay out at first then offered me £450 for it. Argued the toss and they eventually agreed to up it to £650!! I told them that when it was towed away it had personal items in i wanted back but they \'lost\' the car. I asked about money for personal items and they said they had already paid out and that included personal items. I argued that i only agreed to the £650 if i could get my personal items back but they had no records of the conversation. How did the know how much they offered me them?? Got sod all from them and after a year i lost my cool, swore over the phone ( i work in a similar environment and try not to loose it as i know what it\'s like) and called it a day. I\'ve regretted it for the last 7 yrs as i knew i was in the right, so my advise is to fight this, cause if you dont you may regret it. Right rant over, i\'m off for a big jack and coke! Good luck if you do fight it fella

Well here is the letter word for word, I have not left any words or sentances out

So take a seat and try and not to lose your temper as you read as I did!!

“We write with reference to the above motor insurance claim and regret to advise you that as you have failed to comply with the policy terms and conditions we will not be paying for the damage to the vehicle.

Under the claims handling section of your policy it states:

Fraudulent, False and exaggerated Claims

Fraudulent, false and exaggerated claims increase premiums for our policyholders. We will not pay a claim which is in any part fraudulent, false or exaggerated, or if you, or anyone acting for you, or where we have been given any documents which are false or stolen. We will also seek to recover any costs that we have incurred. In such circumstances, we will cancel your policy and we will not return any premium.

During your interview (telephone) with us 3rd July 2006 you told us that you were on the way to car show in Stratford on-Avon where you were to ’show’ your car and that you met other people at a lay by off the M25 when your vehicle caught fire.

We are now in full receipt of the full fire report which states that a fuel pipe came lose while you were driving and that it was spilling fuel as you were travelled and that the fuel ignited as you indicated to pull in to the lay by.

At this point we can confirm that problems caused by mechanical failure such as this are not covered by the terms of the policy and we would therefore be unable to cover you for this event.

That Aside, during your interview with us you were asked if the vehicle was fitted with a Nitrous kit or any other fuel boosting equivalent. You replied that it was not. We have today spoken with a trained vehicle engineer who has now completed a full and thorough inspection of your vehicle. He states that there are fuel pipes in the vehicle in areas where fuel pipes would not be located unless a fuel boosting mechanism were fitted to the vehicle. He has located a fuel pipe T connector that’s is usually used to take and mix another substance with the main fuel supply and is sending this to us as evidence. Another breach of the Policy terms, as we will not provide any cover for a vehicle that is fitted with such a device.

(Now this were I told a white lie that I was not going drive down the strip, but at the end of the day its nothing to do with a claim or fire accident, so him making this statement is pointless other then trying to make me feel like a dirty low down criminal that deserves to hung)

In addition to the above you were asked if you had ever raced this vehicle and if you were planning to race on the day in question. You replied, “no, I\'m not good enough” (I mistook his question as meaning do I race the car round a racing circuit which I never have done)
This is clearly a falsehood as we have written evidence, which confirms you have attended and raced in previous events and that you were on the list to race on the day of the event. Evidence from various websites shows that you have the alias of Blitzboy and we have printed some interesting threads as further evidence of your deceit!
The letter then goes on that I need to collect my car

As far as i can see they are not paying because of the t piece, i would like to think that they have to PROVE that you have used nitrous for them to not pay, as you havent and they cant they have to pay. I would persue this mate, if nothing else just to wipe the smile of there faces at yaking your premium and getting away with not paying out...
Title: Highway Insurance have finally settled my claim
Post by: nikp on July 26, 2006, 02:14:12 PM
No, i disagree Donato: they are not paying, essentially, because it is a mechanical failure, which are not covered by insurances. However, they are stating other \'facts\' (Ok, one is true - the strip - but the other is obviously crazy interpretation of something an \'engineer\' found) as more grounds to not pay out.

****ing w**kers.  What a load of bull.  And what a cowboy outfit.  This machanical failure crap is unbelievble!!  So the only claims they pay out for is where human error is the sole cause?  What if your brakes fail, or you get a blow out?  And then hurt people?  Are they not covering this?  Are they allowed to do this by law?   Isnt that just like not begin insured at all?

I can see why you may not want to drag this out as you will probably get just as much from the parts you can salvage as what they will offer you for the car anyway.  But that is not the point.

These ***kers need puting out of business, need to spread the word

I can\'t believe what i\'m reading. Surely a T piece is not conclusive evidence that u were running nitrous??? :xconfused

No Nitrous bottle, nozzle\'s, management etc... What do they think you just plug it into the T piece on the fuel line and away you go?!?

Can\'t you get an enginer\'s report from RE:WORX saying they done all the work on the car (fuel system) backed with invoices. Or maybe a dyno chart where they tuned it on pump gas!!

I wouldn\'t let it lie mate, you got nothing to loose.

Goodluck with it all.

As far as the nitrous question goes, I guess it is possible that a previous owner had it set up for nitrous and some of the parts have been left in place...But that shouldn\'t affect your insurance claim, obviously. I think they are throwing a number of different reasons into the melting pot to make it harder for you to fight the case. You have now got to :

a) Acertain whether they are within their rights to fail to pay out for mechanical failure

b) Somehow prove that you didn\'t run nitrous

c) Get them to accept that you \'misunderstood\' the question about racing and that in any case that has no bearing on the claim.

It might even be worth having a little chat with a solicitor, you can sometimes get a free initial consultation where they could probably tell you whether they thought it worth pursuing or not.

Just read the so called report from these jokers:mad:

Blitz you gotta fight these pricks, you can get an independant engineer to check your car over as a counter to there so called specialist. Any proper engineer would know to use a boosting agent ie NOS requires more than a T piece. As to the racing bit, its irrelevant you were on a public highway and anyone could\'ve used your log in and typed all sorts of things :yes couldnt they!

Dont back off from them mate, thats what they want

See you on sunday :Thumbs-up

Also .... SCR and Pod do not allow racing per se at RWYB events as it then requires MSA licenses (technicality, but fight fire with fire) you were not racing and have never raced by the legal definition of it as far as the MSA is concerned! You did not lie, you do not race the car (the MSA would require you to have a licence to do so!)

I\'ve had a word with my boss whose a magistrate, and he says what they have mentioned as so called evidence on this forum is not related to the incident at hand and therefore cant be used as evidence as they\'re is too much speculation/conjecture etc. Regarding the Engineer who did the report ask for a copy of this report of his findings and get an independant engineer to do another one.

Also my missus works with a woman at work who spent 15 years in the insurance game, so she will have a word tomorrow. The womans husband works for an insurance company and he just happens to be 1 of the chaps who goes and inspects cars for claims etc.

Will let you know asap.

Mark you need to get onto the financial services ombudsman ASAP. Like now, if you haven\'t already :)

    * complaint.info@financial-ombudsman.org.uk

I\'d be wary about recovering the vehicle. Once you do that you might find it hard to prove there was no nitrous on the car

They Salvage company will take pics for me before they release the car.

Where is the car being stored?  I\'m an Engineer, got certificates and everything - and theres plenty of other engineers etc on this forum.  How about we all go down there give your car an inspection and send it to Highway.
Also, its worth  finding out the name and level of qualifications of their engineer, and wether or not he belongs to any large engineering body.

I think its shocking that FC insurance doesnt cover mechanical failure.

Well I now have a case number with the Ombudsman, before they can act they need me to go through the Insurance Companies complaints procedure first. So Im writing my complaint letter currently.

The car is in Sandwich in Kent at the moment, trying to arrange something so I can collect it next week

May take you up on the offer to inspect the car Brett

Does the car roll on 2 wheels? If so why not just try and hire out a spec lift....t should be considerably cheaper than hiring a flatbed?

Outof interest, what qualifications dos said engineer need to have to be able tinspect? Im guessing chartere status at the bare minimum...but is there any other pre-requisite

well the rear tyres are completly burned out, the fronts were ok, but I havent seen the car in two weeks.

In my letter I will asking for the engineers name and qualifications

Im pretty sure hiring a spec lift is defo cheaper than hiring a flatbed....

If you can get the front wheels on the back and the rear wheels on the front, you can lift up the front 2 wheels.... i dont think you can lift it on the rear wheels cos the fds steering lock doesnt lock the front wheels perfectly straight so the car will sit out at a slight angle....

I think they are just trying it on and dont feel too confident about the outcome, the fact that he has drafted that letter then gone on holiday for two weeks speaks volumes .... he\'s hoping it will all have blown over by the time he returns to work.  As for the "nitrous" they would have to prove conclusivley that you had it fitted and used it .... impossible to do if you have never had nitrous. All that bull about racing your car is not even relevant. It would only become relevant if you had an accident on a racetrack. Not paying for mechanical failures usually means not paying for blown engines/transmissions/diffs. The fact is your not claiming for a "mechanical failure" you are claiming for fire damage. The fact it started becuase of a "loose" or "split" hose is incidental, reports on fire damage are generally to asess wether you have torched it or not.
I personally think that their "engineer" is clutching at straws saying that you car ran nitrous and as for removing parts as "evidence" correct me if I\'m wrong but the car belongs to you still? Who gave him the authority to remove parts? Which to my mind would call into question his reasons for the car igniting. How does he know the fuel connection was "loose" as opposed to "split" before the fire? The fact that loose implies a lack of maintainance whilst "split" implies a failure is more likely the reason he has presented his findings that way. That company sounds like an arm chancing shower of sh1t to me. They dont have a leg to stand on ....recover your car and go for the jugular, you will win.

That was my thought too, after all I suspect a number of accidents are caused by "mechanical failure" of some sort. Say for e.g. a tire had a blowout on the m-way, technically a mechanical failure? can you imagine the letter?:

"Dear Policyholder, Regarding the recent accident which resulted in the damage to 12 cars, and 5 serious injuries was the result of the failure of one of your tires, we refer you to clause 3.55a of section 4 of your policy document. This clause states that any mechnical failure of the car or any part therein will not be covered by your policy. We regret to inform you that we are unable to cover the costs relating to this incident or any of the associated legal costs you may incur.  Additionally, during our investigation of this incident, we have discovered that you have, in the time you have held a policy with our company, travelled at speeds of up to 78mph and not 70mph as you had previously stated. In light of the fact that you have falsified statements relating to your cover we refer you to or policy notes relating to the legal ramifications of false statements on insurance documents. Yours Faithfully, A. W. Anker (Senior Insurance Assessor)

Could lead to a worrying trait?

If they are reading the this forum, I would like to see their faces when they read this!!  They will sh!t themselves.  It must be obvious they are screwed.  It would make good and obvious business sense to come good on this claim now, and on top offer some compensation for the \'mix up\' and distress caused, sack the guy who has dealt with your claim (as he is obivously a muppet) and blame the engineer.

I for one will go to every forum i\'m a member of, tell everyone I know to avoid this cowboy, scamming insurance company. If, and it is very likely, that everyone on here does the same the potential damage to this company will be huge - they would be fools to carry on down this avenue.

There only chance now is to rectify it - and then some.

Quote from: BlitzBoythe reason they are not paying because of mechanical failure of the fuel line at the end of the day

The wife spoke to her friend at work today Blitz, and mentioned something similar to what you have written here. They wont pay for the mechanical failure of the fuel pipe, "But" they have to pay out for damage done as a result of the fire being caused by the mechanical fault, if that makes any sense.
Heres a list of what she suggests for you (alot has already been mentioned I know)

*Check over your certificate again

*Highlight the fact that you were driving on a public road at the time and that it is covered in the terms on the certificate

*If you can get hold of the previous owner regarding any mods done ie to the fuel system etc and did he tell you. ( unless you have had all the work done since stock).

* Who did all the mods, can it be varified by whoever carried out the work.

You\'ve probably done all this anyway but it all helps build a strong case for you.

Oh and she did say Highway were useless!

Hope this helps

Maybe I\'m being an idiot here, but I thought Nitrous if used, was usually mixed in the air stream, plenum, carb or other suitable area, and not injected into a fuel line !?

To run a pipe with both a fuel and oxidant is lunacy of the highest order - that engineer must be so incompetent if he thinks that is what has been done with your car.

Seems their \'Engineering Expert\' doesn\'t match up to the qualifications he should have to do his job - as Brett suggested, I think you might even have a case against his incompetency - talk about fraudulent claims and statements - I believe under English law that swings both ways ?! :)

Good luck with your claim Blitz...

The Engineer could have got confused with the water injection system combined with the fuel t-piece found, which I\'m sure RE:worx will set the record straight on that one. Also shouldn\'t the Engineer be independent from both the insurance company and the owner? ( i think this was mentioned on the XR club thread).

Good luck with it Mark and perhaps look into getting an independent assessor  (Engineer) to check the car over before it is picked up.

Hang about, whats a mechanical failure got to do with all this? Were not talking about the engine just broke are we. If your wheel came off and you careered into another car they would pay out for any damages etc... What a load of tosh. Surely if they know who you are on this forum they could see from any specs you\'ve given on your car do not include Nitrous fitted :rolleyes

I think you\'ll get them to pay up if you keep onto them, Its like their first off on a pay out, always refuse it and they\'ll come back with better.

Good luck mate.

Good luck fighting this M8 ive got some idea how you feel after my fd went up in flames 2 weeks ago. Touch wood my insurance company are gonna pay out. This is just a thought but is it definate that the fuel pipe caused the fire. The front of mine was so burnt out that the engineer said there was no way of being sure what had started the fire on  mine so that may be worth looking into as well as the mechanical failure seams to be the main reason they arent paying out.

Strangely ive had a run in with highways before 8 years ago when they refused to pay out on a claim I had. Fortunatly had paid for the insurance on my dads credit card so we contacted the credit card company and revoked the payment and tied them up in court for two years.

Definatly get a report done by an independent engineer, the enigineer looking at mine was very friendly and helpful but I had to explain to him that the car really was a 1300cc and the usual stuff that people dont understand about rotories.

Good luck

Niall

I\'m a little bit nervous now to say the least, my broker Keith Michaels set my policy up with Highway and I\'m in the middle of sorting things out due to somebody driving into the back of me the other day while I was stationary.

Hopefully it won\'t be a problem as it\'s not my fault and the other person and insurance company has said they\'ll pay.  But I have to say in my dealing with Highway I haven\'t been very happy at all, had to bug them to get the vehicle taken to Dragon and not a normal accident repair centre.  Then they wanted me to pay for the tow, but they have now agreed to get the car there today, although it would seem the car has to be looked at by an "approved" engineer too. *gulp*

I think I\'ll be looking elsewhere on renewal.

I\'ve just signed up with Markerstudy through A-Plan.  This thread prompted me to read through all the small print I had and sure enough they do not cover mechancial failure.  Now I think that is fair enough because insurance is not a warranty on parts.  However, if the mechancial failure results in a load of damage as in BlitzBoy\'s case then that is a hard pill to swallow because they will very likely not pay out.

Does anyone know for a fact that their insurance will pay out if the same thing happens?  I would expect them to all have similar policies to Highway\'s.
Title: Highway Insurance have finally settled my claim
Post by: Shyne on August 03, 2006, 09:13:55 AM
Covering Mechanical Failure and covering damage should not be related, mechanical failure means, if your engine fails your can\'t claim for a new engine, this is a fuel line failing, the result of which was a fire that destroyed the car. the claim is not for a replacement fuel line, its for a car!! If you see what I mean, Highway are one of our insurers (luckily, the broker I work for don\'t cover mods of anykind!) they are a complete shower and shouldn\'t be covering any modifications (the engineers report alone will confirm this"Jakes backalley MOT centre"!)

The Insurance service is now moderated by the FSA and they are doing a reason job at keeping things fair, which your claim decline most certainly is not, however, watch they don\'t switch the tables and try a neglegance trip on you or ReWorx if you gain the upper hand. could be worth reading the letter again.

Don\'t be surprised if you need to see the inside of a courtroom to get this pinned and for the sake of yourself and everyone else on the road, please don\'t give up untill you are satisfied with the result and the payout! For list of mods and reciepts from ReWorx will more than likely be required.

At the end of the day, if you\'ve learned nothing else then its that Highway are sh1t! at least the word is spreading through the forum comunities, gone are the days of the single voice, this claim refusal WILL end up affecting their annual figures and of that I am pleased, honesty is all we ask for in return for declairing every last nut n bolt mod and paying a grossly inflated premium for it!!!!

Title: My letter has been written
Post by: BlitzBoy on August 04, 2006, 11:27:23 AM
Ok guys this is the letter I have written and will post this afternoon

Dear David Salter

Your work colleague Craig Hammond has informed me that my claim will not be honoured. I find this disgusting behaviour on the way he has acted with my case and to what he has written, I have opened a case with the insurance Ombudsman case number 6458498.

Now I will address all aspects in the letter he has written to me (please note I actually never received the letter through the post, I had to ring up, then find out he went on holiday after him promising he was going to ring me, when I rang up and was told the claim was not going to be paid they had to fax me the letter!)

Right onto the first point in his letter quoted below

1)    “We write with reference to the above motor insurance claim and regret to advise you that as you have failed to comply with the policy terms and conditions we will not be paying for the damage to the vehicle.

At this point we can confirm that problems caused by mechanical failure such as this are not covered by the terms of the policy and we would therefore be unable to cover you for this event.”

Right having read my policy and consulted with the ombudsman, we agree the actual fuel pipe failure is not covered, but the subsequent fire damage IS covered by the policy. Now the “Mechanical failure” Exemption clause in the policy is to stop people claiming for broken Engines, gearboxes etc. I think you agree most fire damage to cars is caused by some type of failure of a mechanical part. I purchased a fully comp insurance policy from yourselves including my declared modifications to include Fire protection. Therefore the policy does cover fire damage to my car.
Ok now onto the second point

2) “That Aside, during your interview with us you were asked if the vehicle was fitted with a Nitrous kit or any other fuel boosting equivalent. Another breach of the Policy terms, as we will not provide any cover for a vehicle that is fitted with such a device.”

Ok this car has never ever been fitted with Nitrous! Also any engineer worth his salt knows you do NOT add Nitrous directly to a fuel line, I suspect the T-piece he has removed is to do with the fuel pressure regulation system, I have asked one of your work colleagues to return me this T-Piece (please note I did not authorise any engineer to remove parts from my car, so I think your engineer is breaking the law!)

I can obtain an engineers report to confirm Nitrous was never fitted to this car, I would think the fire brigade or your so called engineer would have found a Nitrous bottle installed in the car.
Also I would like the full name and address of the Engineer and a list of his qualifications please as required by law.
Ok onto the third point

3)   “In addition to the above you were asked if you had ever raced this vehicle and if you were planning to race on the day in question. You replied, “No, I\'m not good enough”
This is clearly a falsehood as we have written evidence, which confirms you have attended and raced in previous events and that you were on the list to race on the day of the event. Evidence from various websites shows that you have the alias of Blitzboy and we have printed some interesting threads as further evidence of your deceit!”

Ok what has accusation of me racing at an event have to with my Fire Claim!?
I think you have to agree nothing, and the ombudsman has confirmed to me on the phone this is unrelated to the claim.
Also I do not hold a racing licence therefore how can I race?
When I replied, “I am not good enough” I took his question as meaning do I race the car round a racing circuit, which I never have done. I think Craig is referring to Drag strip events at Santa Pod and Stratford upon Avon, these are just RWYB time test events.
I agree I have taken part in RWYB events but these are not on Public roads.
These places do not endorse racing at RWYB events, to race there would require a MSA racing licence.
I know insurance do not cover on these premises. But I still ask the question what has this got to do with my Fire claim? The fire occurred on a Public road where by I was meeting my friends.

I think the only reason Craig Hammond has written this is to belittle me and make me feel like a criminal, I take great exception this and I am considering suing Craig Hammond personally this is defamation of character.
Therefore can you forward Craig Hammonds’ address and his FULL name, which I will hand over to my Solicitors?

I have now had to collect my car as the salvage people had instructions from Craig to dismantle it. Previously I was told this was CAT A write off but upon collecting my car was told it was changed to CAT B in which could be sold and put back on the road, I feel Highway or probably Craig has thought that I would have given up my claim felt the car was unrecoverable because it was CAT A and left it to be disposed of and Highway making money out of the Salvage, if this turns out to be true I am very shocked at this behaviour.

I have now had to dismantle the car to make sure it doesn’t get put back on the road, I am still pursuing my claim, I therefore ask you to pay the claim, at the time of insuring the car I gave you Highway the approx value of £15K, I have provided you evidence of its value and also adverts for similar cars on the market from 9K upwards. I therefore ask you to make me an acceptable offer to me.

I think I had better inform you as well that I have informed my car club and other car clubs with my case with Highway Insurance and they are following this closely and are presently quite shocked at how I have been treated, many people in my car club and other car clubs are insured with Highway. So far 5000 people have read my story and counting.

On a customer care front, Highway in the two months that have dealt with my claim have never sent me a letter in the post or returned any of my phone calls! It’s always me ringing up to chase and to find out what’s going. Also Craig Hammond has lied to me on the phone saying he was going to me ring back, he also lied to say the only reason why my claim was taking so long because they needed another engineer to value the car as the first Engineer valued it at 2K, he never told me my claim was ever in dispute! The only people that were efficient and fair were the last two women I spoke to on the phone all your staff should lead by their example as they were very professional but Craig Hammond was not.

I hope you can deal with my claim efficiently as it will show others who are following my case that Highway can be fair.
Please can you send all correspondence to me via recorded delivery, as I will be, just in case this matter goes before the Insurance Ombudsman or court.

Wooooooaaaah!!! I didn\'t realise half of this, you\'ve been lied to on more than one occasion to affect decission, tricky to proove, but definately seems as though they were applying any information they could (true or false) to get you to walk away (which you almost did).

Keep in constant contact with the ombudsman for any info or advise you need, I know we claim to record calls as I think its a requirement of the FSA that this is done for a certain percentage. You may benefit from requesting these call records be recovered to back up your evidence against Graig Hammond.

Best of luck Mark, stick with it mate!!!

Hi. I\'m a member of the celica-club, and there is a link to this thread on our forum.

I\'d like to add my support, and say that I for one won\'t be using Highway Robbery for my insurance after hearing their about their behaviour.

This is what I wrote on our forum

QuoteThey should be shunned for this treatment.

What happens if you buy a second hand car. You can\'t be expected to know every mod (if there any) that has been done to the car. Some are very small, and the average person wouldn\'t have a clue that its there. Therefore to have an engineer find one and then the insurance company refuse to pay out, is frankly disgusting.
I\'m sure that there are a lot of cars that have been modded, then demodded, and sold on, that still have remnants of the mods remaining in the car.

I hope Watchdog get involved.

" Thank you for your recent letter dated 4 August 2006, informing us of your dissatisfaction with the handling of your claim. I am sorry that you have had cause to complain about the service that you have recieved.

I have escalated the matter to the Mr D Salter, Head of CVU, who will now conduct an investigation into the circumstances and provide you with a final response in accordance with our complaint procedure. You should receive our final response within the next 10 working days, although occasionally investigations may extend beyond this peroid. I find the inclusion of the word \'unlikely\' in the final paragraph a little strange. Can\'t see why they would pre-empt the results of their full enquiry in this way. It does sound promising, but I would advise you to keep your expectations modest at this stage and in 10 days time hopefully all will be revealed.

Well Spoke to Reworx today and some other good news, The fuel leak was not caused by faulty connection or a Mechanical failure of a fuel pipe.
It seems my car had some kind of rear accident and repaired over in Japan as they have found evidence of welding, looks like when Jap repairer refitted the overflow fuel pipe on the neck filler this was not done correctly therefore leaking out fuel on a full tank. The Insurance engineer should have picked this up ,so points to their engineer has not properly looked at the cause of the fire, seems their engineer is a bit of a monkey.

Title: Highway Insurance have finally settled my claim
Post by: BlitzBoy on August 17, 2006, 10:40:22 PM
I dont think they have anything in the exclusions that can claim they wont cover Faulty Workmanship, this would mean they wouldnt cover cars that have inherent design faults as they could claim this is faulty workmanship. I mean the whole idea of fully comp insurance is to cover every eventuality. How can an owner be responsiable for faulty workmanship?, so long as an owner looks after his car eg servicing, MOT and has furfilled his obligations in having the car road worthy and had not delibrately or maliciously damaged the car cant see them not paying out.
The fire policy covers for the subsequant fire resulting from mechanical failure in my eyes, as most type of car fires are caused by some type of mechanical fire anyway.
Title: Highway Insurance have finally settled my claim
Post by: yogibear on August 18, 2006, 02:54:27 AM
As long as the car has an mot really it is considered road worthey is it not. Fully comp insurance is surposed to be that comprehensive. Maybe Highways should look up the definition of comprehensive in the dictionary. There are exclusions in fully comprehensive ,ie if the vehicle is damaged in an act of terrorism, civil unrest, due to war but fire is most definatly covered.

Would Mechanical Failure be considered an act of God I wonder???

Over 15,000 views of this thread now, if they dont pay up that will be a lot of people telling there mates how highways rip people off.

Hi from Volkszone

http://www.volkszone.com/VZi/showthread.php?t=289715

Apologies if I\'ve missed it in the thread, but have you actually posted up the policy wording about mech failure that they are relying on ?

Could you (scan it and post the pic maybe if its a pain to type it out ?)

Not seen the policy, so obviously can\'t be sure, but - as a lawyer, but not an insurance lawyer or expert - I would be very (very!) surprised if they are right about this.

It would be worth knowing what the policy actually says though

If you are right - and your policy confirms this - IMO you should be prepared to look at taking this to Court.  What\'s your claim worth ?  If its less than £5K you would probably be on the small claims track, very informal, very limited costs risk for you

Start here:

http://www.dca.gov.uk/civil/procrules_fin/contents/parts/part27.htm

If you go this route, read the rules carefully, and read everything you get from the Court carefully - you don\'t need to be a lawyer, all the info is there, you just need to take your time and be careful

Best of luck, and post the wording up ?

Quote from: PhilAn additional note: They cannot use anything you say on the internet forums against you in any way. Quote from: BlitzBoyYes I realise they cannot use what I write on here in the case,

I really think that\'s just not right (I\'m meant to know about this stuff ;) )

it might not be as strong evidence as other forms of evidence (such as oral witness evidence in Court), and if there was any real doubt about who said it then it would be very weak evidence,  but there\'s no bar at all on it being used....  (in a civil case such as this anyway)

[EDIT:

Is this, what the policy says ? (from the Highway website, standard car policy)

If so, I agree 100% with previous posts on here - this is not an exclusion of damage resulting from mech failure, it is an exclusion of the cost of remedying the mech failure itself.

In the same part of the policy, where they mean to exclude damage resulting from something, they use that exact phrase.  The \'presumption of internal consistency\', as well as the ordinary meaning of the words used, means they haven\'t got a leg to stand on

Finally, if you get no satisfaction, why not drop this guy a line:  http://www.highway-insurance.co.uk/highway/uploads/press/LeeRadleyapptV3-04.06.pdf  ;) ]

Hi, Been passed the details of this one from another site.

I actually work for an insurance co, in claims, please don`t shoot me. For reasons i`m not going to say who. But before you ask it`s not highway.

Just to help on a couple of points. The reason for the complaint letter wording is that it`s a standard letter. They are following the complaint procedures set out by the FSA.

This is why it has the strange wording, "if you are still not satisfied". It`s because they may or may not resolve the complaint to your satisfaction.

Only after you have received their "final response" letter can you complain to the ombudsman, the FOS. Their system is quite easy to deal with and i`d go there before going anywhere legal.

You will also probably find that your Motor policy legal cover has a clause to stop you using it to sue your insurer :( so you`d either have to pay for it yourself or use a legal cover you have elsewhere. The ombudsman is pretty fair though.

You\'ve already registered this event with the Ombudsman havn\'t you Mark?

Like General Bob says, its a standard letter sent out as a kneejerk reaction to a letter of complaint, I think every single piece of mail that leaves our company is a standard letter or Template even letters containing event specific details are usually encapsulated with standard wording.

Its sad to say that it looks like they will go to the beaches with this one, you\'ve just got to hang in there and fight them all the way mate!!! stick with it fella

The AA should be sorting all this out for you really, that is what you pay them for.

I would advise to speak to the AA again and get them to help you.

I had a problem with an insurance company once, and my broker (not the AA)went out of their way to help me.

The AA!!!!  What a bunch of Tw4ts !!

Had an EGI once, and  I was stupid  enough to go with them for the first year, because I didnt know any better. When it came time for renewal,  their best quote was £250 more than what I could find. They sent me this letter saying they had "researched" the insurance companies to get the best deal .

I wrote back to them tell them their research was done on the best profit and not the best deal for the Customer!  Of course, I never heard anything back from them.

Lets get the revolution going, these guys have a captive market, because we have to have insurance - so, basically, we are screwed anyway. But just maybe we can start pushing them to treat us right.

Anyone put this on the MX5 OC forum yet?

And sure enough, a couple of them gave me quotes underwritten by Highway Insurance! Thank God they weren\'t the cheapest quotes, though!

If anyone has shares in Highway - as news begins to spread things could take a downward turn for them.

At the moment the pace is so so, but news leaks quickly so keep a watch on the tickers :

I suspect you\'ll find that Highway are an insurer aimed at higher risk cars/drivers. I have only ever had highway quotes or policies as a young driver and/or with a higher group vehicle, never with a bog-standard car.

Hi, I am the head administrator for the Ssangyong owners club (Korean 4x4\'s for those who dont know) and one of our members posted about this on our forum. It is quite worrying since most 4x4\'s that are actually used offroad will have been modded in some way or another and would probably fall foul of the rules of this insurer.
Whilst I assume that a lot of mods made to RX\'s and most sports cars are to enhance performance most mods to 4x4\'s are to enhance safety for using them off road but would still be loaded by the insurance co\'s in the same way.
I hope that you are sucessful Blitzboy so that this thing doesnt become the norm for modded vehicles. I am sure that you can add all 2200 members of the Ssangyong owners club to the many others keenly awaiting the outcome of this travesty.

Hi all, I\'m from the Ford Probe Owners Club thanks to a link from Bob. Yes mate, your link worked:Thumbs-up

I\'m currently with Highway Insurance and needless to say, I won\'t be with them again next year when I\'m due for renewal:Nono! I hope they are keeping tabs on this post because everyone who is with them so far over on FPOC have said that they will be leaving them on their renewal date because of this:Laugh

I\'m only insured third party, fire and theft anyway as the Probe isn\'t worth as much as your lovely cars but I should be insured for FIRE, and according to this case, I\'m not:mad: If they aren\'t paying out due to a machanical fault, then they are obviously selling misleading insurance so blitzboy, take it all the way mate, you are 100% right in saying that they should payout!

Put it this way, you pay your insurance to be covered for fire! What causes a fire in a car, either a machanical or electrical fault. If they say they aren\'t going to pay out because of either of those, then their insurance is worthless. The only other way for the car to catch fire is for you to throw a match to it and then your insurance would be invalid so they are saying that you pay for fire insurance but you can\'t claim on it, that seems like theft to me, of your money!

Take it all the way mr Blitz, you may even be able to sue them because of it. maybe a long shot but I can\'t see why not. And why the hell is their mechanic, dismantling your property? the vehicle only becomes their property when they have paid you for it and you agreed to not have the car back. Destruction of private property, another case to sue their ass for!

And before the Highway Insurance snoop tries to find out who I am to give me a hard time, don\'t bother! I never claim on my insurance anyway as i think it\'s a waste of money and my premiums will only shoot up to £1200 if I lost my no claims and it\'ll cost me less than that to get another probe:guinness

hi,  just popped in to give you some support, (thanks to bobs link on gso)

i cant see any way you will not win this case, this will be a great victory for you, and for EVERY motorist. highway will lose masses of business, as word of the way you have been treated is spreading like wildfire.

since the link on gso (lastnight), it has be linked again, on at least 7 motoring forums that i know of, and no doubt they will be linked again, im guessing around 100 forums must know about this now, and how many members in each forum, linking it again? this is all over great britain.

if they dont settle your claim soon, they could well bankrupt themselves next year, do they realise how many potential customers are awaiting the outcome of this, not that anyone who has read this thread would ever consider insuring with them.

wishing you all the very best (no luck needed)

Russ

I think these people are appauling, I along with many others pay for my mods on top of my policy each year, for them to then say get lost !

They should be written off the insurance planet instantly.

Anyway, rant over, just thought i would show some support on behalf of us lot, we have links to many other major automotive based internet sites and the word has been passed already. Lets see if we cant put them out of business by the end of the year :)

Well got a reply from them today, thinking it was the final decision letter ohhh but no I was wrong I have to fduking write to another department for that if I am unhappy with their reply to the complaint!

Yeah too right im unhappy, drafting another letter to them and the other department as we speak..... oh I have attached the letter below, notice they have dropped the Nitrous claim they had against me! yeah to right they dropped it because their so called engineer is wrong! They still insisting I race, I will contact Clive so he can say something to the effect that RSIII is a car show with timed runs not BL**dy racing!! I do not hold a race licence!! cant they get that through their thick heads! and as far as I know I have not entered any GT championship events only in my dreams!!!! argggggggghhhhhhh

letter below from them

"Thank you for your letter of the 4th August 2006, which has been referred to myself as the person responsible for complaints in the Claims Validation unit. Your complaints against Highway Insurance concern the way in which this matter was dealt with and the outcome concerning the indemnity for the above incident. I have now fully looked into the matter for you.

I am sorry if you found our claims process concerning. I have noted your comments and investigations has confirmed that the process was correctly administered throughout the period of dealing with your claim. You should rest assured I would take the appropriate action if any member of my staff failed to meet the high standards of customer car, which we insist upon and which customers are entitled to expect.

Your claim was primarily declined because the incident fell outside the scope of the policy. The Surrey Fire & Rescue Service extract of fire report states: “Accidental – Fuel supply hose disconnected whilst vehicle in motion, causing fuel to spray into and under luggage compartment. Ignited when indicator tuned on to pull into layby”.
The engineering evidence we have obtained has further supported this. Your policy clearly states under Section 2 Fire & Theft, “What is not covered, Wear and tear, mechanical, electrical, electronic and computer failure, breakdowns or breakages.” As the fire was caused by mechanical failure there can be no cover for damage to the failing part or parts.

The policy under General Exclusions states: “This Contract of Motor Insurance does not cover claims arising from any of the following: 7 The insured Car being used on any form of race track or off-road activity” When this office interviewed you on the 3rd July 2006 you were asked if you had ever raced this vehicle and if you were planning to race on the day in question. On the recording you stated, “No, I’m not good enough”. When asked at the end of the interview “ Do you agree that everything you have told me is to the best of your knowledge and belief a true and accurate account of what did eventually happened?” you replied “yes”. You were then advised. “I must advise you that should Highway Insurance later discover that any of the main details you have given us are deliberately misleading, we shall refuse to pay your claim and report such matter to the police for prosecution”.
Highway Insurance has subsequently discovered that you have raced this vehicle previously and on the incident day you were listed to race. Not only is racing of any description outside the scope of the policy, but it also falls outside the scope of the underwriting criteria and had Highway Insurance been aware of your racing the insured vehicle at the inception cover would not been given.

Regrettably I can see the no grounds to rescind the decision made in our letter of the 21st July 2006.

I trust that I have clarified our position and that you now fully understand the explanation for my decision on this matter. If however, you feel that I have not fully addressed your complaint, you should within eight weeks, write to the Compliance Manager Highway Insurance at 171 Kings Road, Brentwood, CM14 4EJ, to review the matter for a final decision. We shall consider the matter resolved should we not hear from you in this time. If you remain dissatisfied after receiving our final decision, the matter may then be referred to the Financial Ombudsman Service, details of which we will gladly provide should they be required.

Yours Sincerely

David G Salter"

These guys are absolute scum,

The racing thing is totally irrelevant to this claim.
If it happened on the strip fair enough, fair cop, but it happened on the roadside.

Their policy wording above suggests that any fuel fire would result in them not paying as it would have to result from a mechanical failure of some sort or wear and tear, how else could it be caused ??

This makes no sense to me... I wonder if my insurance is worth the paper it\'s written on.

I am going to write to my insurance company giving this as an example and see what they say because I take my car on track days , drag days etc and whilst I accept I wont be covered on the track, I expect it not to otherwise affect my policy....this is just absolute drivel I\'m sure...they just dont wanna pay out at any cost.

Racing by definition is in competition, a rwyb event is not competition.
Title: Highway Insurance have finally settled my claim
Post by: Prof on August 30, 2006, 07:59:24 PM
It sounds like they are refusing to pay on the grounds that you \'have raced\' and said in the interview that you did not \'race\'.

It also sais that they will take the matter up with the police, so the implication is that the boys in blue are on there way round to your house Mark :spank

Or probably not, as I suspect this is a standard secondary refusal letter, and they probably know they have no grounds to bring any form of criminal prosecution against you.   The fact they have printed this accusation means they are potentially opening themselves up for prosecution under Libel (as this is in written form), but it all depends on the definition of \'Race\'

According to the free dictionary (http://www.thefreedictionary.com/race), we are all guilty of racing, so all insurance is void !!

However, since they have come to the conclusion that the fire was started by your indicator and a leaky fuel pipe as you pulled into a layby, I would imagine that your speed was virtually 0 Mph, and there was probably no competetive element to your doing so.  By any definition, parking a car is not racing :Nono!

Good luck with the next round :yes

Before you do that Mark, do you think there is any possibility this could backfire and damage the club in anyway? To them it is an on-going dispute! could they take action against or sue the club?
I wish you well of course matey, but must say i am a bit worried about this!
Anybody know how the club stands??

I don\'t think the club is in any danger from this.....I personally don\'t think an individual jobsworth in the company will back down though, no matter what the groundswell of opinion is on the various forums. I think now they have put forward their case they will defend it stubbornly to the end. I think this is a case that absolutely DEMANDS to go to court because I think a half decent lawyer would take them to pieces....Perhaps we aught to see if there is any interest in making a test case out of this and petitioning for donations towards the potential legal costs to fight the case. No individual would have to stump up a lot of money, there are hundreds/thousands  out there who may be prepared to chuck a few quid towards bringing highway to task.

Edit...I wouldn\'t go out of your way to direct them towards this forum though Blitz. They may already be reading it of course (they have been on before at their own admission) but I don\'t think there is anything to be gained by it.

My reply would be something along the lines of:

The Surrey Fire & Rescue Service extract of fire report states: “Accidental â€" Fuel supply hose disconnected whilst vehicle in motion, causing fuel to spray into and under luggage compartment.

I am not asking for you to re-emburse me for the loss of the fuel hose, I am however requesting compensation for the losses caused to my vehicle by the resulting fire. This loss IS insured as clearly stated in the policy.

Can you please classify to me your understanding of the phrase "being used on any form of race track or off-road activity". Would you statement include parking on a private car park as an off road activity? Would the intention to use a private car park be required to be declared at this point in the interview also? I should remind you that at no point when I may have mentioned any intention to race on internet message boards in the past was I under oath, and since I do not remember making the statements shown in your evidence I ask you to a) prove that it was myself who made them and b) understand that any previous statement made by myself may have been subject to a later change of mind; and so whilst at some point previous to the event I may have intended to use the insured vehicle on a race track (at a licenced public \'fun day\' event where racing of any kind is strictly prohibited) it was clear in my mind on the day of the event that I had absolutely NO intention to race the insured vehicle or take the insured vehicle anywhere other than the spectators car park of the race track.

Had the insured vehicle been involved in an incident on a race track then I fully understand that a claim would not be honoured, however this incident occured on a public road and was completely un-related to any racing event whatsoever. You must take into consideration the fact that I was very distressed by the incident and the loss of my vehicle, which is also my prize posession, and your intense method questionning regarding the claim further increased my stress levels at the time.

I feel that this is completely unrelated to my claim and the cause of the incident, and frankly I am disgusted that you are trying to reject my claim on this basis.

David G Salter

Quote from: Philsome really useful stuff

You sound like a lawyer (no offence intended!) and that\'re really good advice.  To summarise...

1) BB isn\'t making a claim for a parts failure but for the loss caused by a fire.

2a) There is no proof that BB claimed to race as the forum is not secure or viewed as a testimony under oath.
2b) The whole concept of racing is a huge red herring as it\'s irrelevant to parking a car in a layby.

It might be an idea to contact the major insurance companies and fleet companies and point them to this thread.

Just one small point from their letter: I quote

Fuel supply hose disconnected whilst vehicle in motion

Reading that suggests to me that they are implying that the fuel pipe was physically disconnected, they don\'t say \'became disconnected of failed\'

Are they trying to suggest this fire was deliberate.

Just seems an unprofessional term to use.

I have just got off the phone to my insurer enquiring wether or not I had cover given the same circumstances. They have advised me that it is a common exclusion on all motor insurance and basically it comes down to two things.

Any mechanical failure is either down to a manufacturing fault or the result of incorrect/non-existent maintenance, therefore it is not covered since it must be the fault of either the manufacturer, the owner or a garage!!

Apparently the FSA, one of the insurance governing bodies backs this exclusion in all motor policies.

PLEASE NOTE: this is what I have been told and is not my personal opinion. It may also be the case that the information I was given could be incorrect.

Not giving you a flaming here (As you say, not your opinion, but from an insurance company direct), but what!!? As far as insurance companies are concerned, those are the only reasons for mechanical faults!? What about normal wear and tear? Things fail! What about a wheel bearing failure - these will eventually happen, and although to get to the point so severe that it causes the crash is unlikely before you notice it - if that happened and you crashed, they\'re saying you wouldn\'t be covered!

I\'d hope insurance companies are more realistic than that!!

^ I agree, going on thier logic, if my car goes on fire I\'ll be aiming for the nearest tree so that I can say "the impact caused it" and I\'ll claim personal injury as well.

Any car thats gets serviced/MOT\'d is only passed for the time it is on the garage forecourt.  A friend of mine that runs a test station says he\'s had people arrive on bald tyres, swap their mates wheels over and then enter the car for the test, he has no choice but to pass the car and as soon as they have the cert they swap them back again.

Its like house insurance saying... that plug that was at fault... well it should have been maintained.

This definitely makes the blood boil!

yeah it just makes you think the "fire" part of an insurance policy is utter crap and is not worth the paper it is written on, false advertising I reckon.

But as been said before Syandi, they wont cover the "mechanical part" that has gone wrong but they should cover the "Subsequent" fire resulting from Mechanical failure

whilst I baulk at the thought of putting fuel on the fire...(no pun intended BB)  I must admit that I had omitted that fair wear and tear as well would be considered as the owners responsibility, and therefore not covered under the policy.

In addition it is worth reading some of the exclusion clauses in your insurance documents and just how ambiguous some of them are. For instance the comment from alexb about arson...this could be argued that it comes under the "civil disobedience" clause...

Just makes you think what we are all paying for....

Also dont forget that anything, and I mean ABSOLUTELY ANYTHING you have fitted to your vehicle that is not an originally specified part can be used to wriggle out of a claim, this means that new stereo you treated yourself to could cost you the value of your vehicle should you need to make a claim. Or even the fitting of something that enhances the safety of your vehicle, like foglights!!

God it\'s depressing isn\'t it?! Funny how *buying an insurance policy* is a legal requirement but the insurance co. can take the **** when it comes to the time we have to claim on that legally required policy... Come to think of it, would state insurance be any better?

Anyway, the point about fire cover is surely not the cause, but the consequence. Keep it up BB :)

Alex

Good luck with fighting Highway, if it does indeed go to the ombudsman, then you will almost certainly win. I have had to resort to using the ombudsman in the past and I am happy to say that I won.

This can\'t be the first time that this has happened and there must surely be a test case somewhere on the legal side of things. If it went before a court, you should have every chance of a victory, together with costs and expences etc.

Oh and guess who I\'m insured with?............yep - Highway.

Highway also cover me for trackdays, at an agreed £75 per event on the Skyline valued at £15K with all modds declared.

They shouldn\'t be in the insurance game if they don\'t want to settle valid claims.

I hope people remember this episode and do not use them in future, spread the word, there\'s too many reputable companies out there. And let\'s hope other insurance companies take note.

I\'m glad it\'s all over for you -  you must feel great well done.

We will never know for sure how much influence the thousands of posts on hundreds of forums influenced them, lets think it was a victory for the masses.

Just out of interest what was your original claim amount?

John

Well at the beginning of the claim they never actually asked how much I wanted, I was looking for 10 K personally with out the salvage of my car. But with 7K plus my salvage it works out spot on what I wanted.

Oh yeah John would you be able to change the title of the thread just to let peeps know its over but keep it as a sticky to remind people this is a victory for the normal men on the street :Thumbsup!

OK lets take one step back - according to their policy you were not covered because it was a \'mechanical\' fault.

Well the fault hasn\'t changed, they have\'nt re-written their policy terms so what would happen tomorrow if I had exactly the same issue?

We all now know I would use this thread as an example but does\'nt this mean the wording in their policy document is wrong.

They have paid out on a mechanical fault that they say they don\'t cover.

All very confusing don\'t you think.

BlitzBoy will you get anything in writing explaining their reason for the \'U\' turn.

John

Congrats Mark - really glad they settled and you\'re happy with the result.

Also - well done Highway for revisiting the claim and eventually dealing with it in a reasonable manner.  It\'s a shame insurance companies make life so tough sometimes but I guess they do have a duty to protect themselves from fraudulent claims.

Sounds like an admission that it was badly handled and maybe an edict will go out to their claim handlers not to try heavy-handed measures against policy holders!

Quote from: johnfWell the fault hasn\'t changed, they have\'nt re-written their policy terms so what would happen tomorrow if I had exactly the same issue?

John, I suspect the issue came from three things:

1) a misinterpretation of what constitutes a mechanical fault (e.g. insurance doesn\'t cover wear and tear) compounded by:

2) Assessor getting it wrong and claiminf NOS was used!

3) trying it on with BB\'s career as a professional Indy Car racer (Mark you can come clean about the F1 sign-up now too)...

Yeah Ferrari have just signed me up , going to Modena for a test in there 2007 car hahahaha

Well I wont get anything in writing according to Pete as I reckon they dont want to admit they were in the wrong or set a test case I suppose.

From what I can gather with the phone conversation, he sounded more concerned on how the case was handled and was apoligising for that not on the actual mechanical failure claim, I put his concern down to how Craig Hammond had called me decitfull (a liar i suppose) in his letter, I suppose me destroying the claim of NOS use prooved I was not lying in the first instance, but I suppose if i had the money and energy for it I could have sued Craig H\'s for deformation of character

Great news Blitzboy. Congrats :Thumbs-up

But it does raise an interesting question. Now highways insurance have learnt a valuable lesson are they still worth considering as a car insurance company??

They have seen what can happen if they mess some one around. Are they likely to do it again???

I would say steer well clear of Highway now and in the future...A leapord never really changes its spots and they may have bowed to forum pressure this time, but why risk having to go through this process everytime you need a payout.

imho .... NO WAY!!

I\'m glad its all sorted, and am really pleased for you blitz, but you shouldn\'t have been put through all of this in the first place   , i think they just wanted it to be over for them quickly tbh.

I\'m glad this post has spread like wild fire as this is the kind of thing that should be made public not just all the \'great deals\' all these companies can do for us.

I\'m steering well clear of highway in the future.

And again congrats on your settlement blitz. :Thumbs-up

Ok here is the article posted in the Guardian last week:

quote

Motor insurer Highway Insurance saw profits fall 33pc (%) to £7.5 m in the first half as it said car insurance premiumes continued to weaken as competitors continued to cut prices to gain market share. It said premiums had not kept pace with claims inflation.
However, cheif executive Richard Gamble said: "Highway is well positioned to take advantage of an upturn in the markets when this emerges."

end quote

Ha ha haaa !  ROFLMAO !!!

Post by: Prof on September 15, 2006, 12:11:12 PM
just been digging around to get a quote for my steed, and with a view to doing some mods, I requested they not include Highway in the search.

On the 2nd call back to Adrian Flux - the contact there had checked up on the \'Highway\' issue - new all about the fire, and apparently others have requested not to include Highway either - seems the reputation is damaged even if they have settled.

seems people power really does work.

well Ant according to Prof "people power" did work and the word had spread to the brokers then onto Highway, so I think this is the reason why they did the U-turn.

Title: Its happening again...
Post by: Scorpio User on September 17, 2006, 10:28:23 PM
Folks,

I realise that you got up a real head of steam to help out Blitz Boy but one of our members is having a similar sort of problem with Norwich Union, except in his case by the time the Fire Brigade had arrived he had been able to to put it out before it became a major blaze, however problem with the Scorpio is that loom/fuse box damage is big time expensive and NU don\'t seem to want to know.

Can I ask that if you get the chance to look at this link and want to pass it on that would be great. If you are a member of other motor type sites can you post a link on so that their members insured with "QUOTE ME HAPPY" can check the terms with their brokers?

http://www.fordscorpio.co.uk/cgi-bin/yabb/YaBB.pl?board=Advice;action=display;num=1156768666;start=

Problem for Ashley is that his brokers are the RAC and NU are part of the same company.

If you can help thanks for it!
