Hi Guys
I have spoken with RX Heaven and have agreed to remove the thread temp.
Im going to talk to Clive/Glen and they can make the dissission as to whether or not it is reopened.
Please dont flame me, but call me, I am always here to help when I can.
Im off out now 07973 111333 so cant answer mail of threads.
May i ask why???
Just to say spoken to gary all is in hand. To be continued......
Hi all,
I have spoken to Nigel of RX-Heaven today.
At this stage, I have said to Nigel that we will move the Thread. The thread is obviously damaging to his company, therefore we feel that at this stage it is in everyone\'s best interest to let the legal proceedings to go ahead. When things are settled legally it can then we will review its discussion again.
Please remember that this is an open forum, it really isn\'t the best place to discuss legal matters.
The club does its best to look after both members and vendors - discussing serious issues like this one publically is not a good idea - especially if legal action is also taking place.

Hi McCARTHY, I have tried to email you - but your email address is bouncing. Drop us an email if you like: team@mazdarotaryclub.com
hi ya message sent to you
Cheers
Looks like they will get away with it again
:Kieron throws his toys out of the pram:
I will not be renewing my membership next year.
the battle ant over yet dude.....
Kieron
I dont think they have got away with it, the cat is already out of the bag as they say, I mean who is gonna use them now!
"When things are settled legally it can then we will review its discussion again"
If either of you guys win please then feel free to post the outcome and the thread will not be closed, as l said at the start we need the facts on the forum for others to see and this means if either or both of your cases are successfull the club would be duty bound to post the outcome to protect its members.
Kieron, you need to respect that this is not just your club/forums but all the MRC members.
Please allow things to take the coruse that they take, and go from there.
Fish
Thanks Clive
I was beginning to worry as I thought maybe the whole thing would disappear and we would never know the outcome.
I guess Glen and G11ary have done the right thing. I really hope the whole can be resolved amicably and reasonably.
But I would dearly love to see the outcome - hell if we cant tell each other on here which vendors give good/bad service, then I would be very disappointed!
A question to the administrators. During the legal proceedings of this case, shouldnt we suspend RX-Heavens Vendor status and remove their advert until the outcome of these cases?

Thats what i was trying to say.
Can i just clear one thing up people so don\'t the wrong end of the stick on the thread thats was removed. This was not a deliberate attempt to make people steer clear of RX Heaven, it was simply that of 2 people that have had bad experiances of the same company. At the same time i would like to say what was said was backed up by photo\'s so i don\'t see what was wrong with it though i do understand the position of the club

unfortunatly it would look like myself and kieron have tried to resolve things this way already. It didn\'t happen hence the leagl action
Blitz boy, i don\'t see why they should be suspended form the vendor\'s for now as they arn\'t the first people to have leagl action taken against them. If you where to peanalize any of the vendors anytime someone had a dispute with them we would end up with none!!! Everyone disagrees once in a while but it is up to the people involved to sort it. After that and we have an outcome then i think its time to look at suspending and things like that.
True true I accept your point, just makes me angry when I see people get ripped off for a couple of thou, when I saw that thread on porting and the pics I thought wtf!, we are not talking peanuts here.
I guess we shall wait and see the outcome McCarthy (Ps I hope you win)
Thank you for your support
Guys,
Can we not let the stuff from the other thread resurface here please. We\'ll make sure there\'s a full dissection of the outcome as and when there is one. We should place this topic \'sub judis\' for now.
This is to protect MRC in the main - both reputation (if vendors feel that the club will not give reasonable protection then they\'ll leave) and from prosecution for hosting \'libellious\' posts.
I\'m not making and judgements here but let\'s make sure MRC is kept safe. :)
Credit to McCarthy for his positive attitude and response to BB\'s earlier post too!

don\'t you worry we will keep you up to date om all that goes go.
Hey all, just looking at the thread, sad story all round! I have had a similarly bad experience with a glorified parts fitter before... McCarthy Knows all about that too he helped tow the shell home! lol But really just wanted to say im sorry to hear this has been the case for you guys. Hope all gets sorted out for the better soon!
you should have gone for the SR20 lump :D :D :D
It seems that people have missed the point with my case and have e-mailed RX-HEAVEN giving them support.
YES John, my car was running lean, well done for running off and telling NigelAlthough he already knew this cos he sold the ****ing thing to me!!! :reallymad
I am not in despute over the detonation!!!Do I need to repeat this anymore?
Damaged beyond repair end plates, missing oil seas, no porting, reused housing painted to look new, three coolant leaks and one oil leakYeah looks like I got my self a read bargain there :spank
I also know of other people who have had problems with them, not just McCarthy, 2 other MRC members.
I found this on another forum!!!! POINT PROVEN!!!!
QuoteWell we now have found out why another ones of nigel fright of RX heven

THERE IS ALOT MORE WHERE THAT CAME FROM!!!
Kieron, as much as I feel for you mate, this is not the way, and will only start a massive on line brawl, which wont be allowed. Dude you know you can talk to me. This thread must NOT turn in to the previous thread that has been temp removed, pending outcome. There will be a time and a place.
Flame away but I also have a job to do on MRC and its members :flamed
I understand your position mate, I will give you a call later, any time good for you?
I\'m ****ed off with John Yorke :reallymad he has really missed the whole point of the original thread.
Now there is 3 rotary boys (one PMed me on FDUK earlier today) with the exact same problems and dodgy work, painted housings to look new, reused end plates, no porting work when we were sold ported engines bla bla bla...
I am glad that the forum I lifted the quotes from have kept them. They are protecting there members!
Kieron.
P.S I finally got a reply from him today! Shame he was just trying to scare me off again.
You and i both know the facts and both our solicitors are aware of those. There will be a time and i don\'t see it being to far in the future. Once the out come is announced the old thread can be put back up. I mean don\'t get me wrong i think people should be aware of what we and a few others have been through regardless of the outcome.
However there are threads up against other vendors from other people who have had bad experiances so why should RX Heaven be protected? This is the only remaining question in my head. I mean look at the bad press Hurly have on MRC and other rotary site\'s why arn\'t those threads removed???? If they were to phone the moderators of the site and complained that what was being said was damaging would they have to be removed..... but then how far do you go? is then all bad press on any tuner removed. This is an open forum to all owners and their experiances. Nothing said was slanderious and was supported with photographic evidance so as to show it was not made up. On this basis can i ask is my piont wrong??? and again i would ask you revise your veiws on having removed it? We have no real idea how long tis will take.
One futher point can i ask that if any one else other than my self or kieron have had experiance or know of and one who has had dealings with RX Heaven to please get in touch with me at JM-garage@hotmail.com i would be very greatful
Have you spoken to DC yet?
Dc? am i being silly?
Yes you are ;)
YGM :D
Hi Guys
Both you guys can talk to me whenever you want, you know that. You are right the threads are in abeyance not deleted, yes pictures are great for seeing problems. Im not going to get drawn in to the whys and therefores of the first thread being pulled, and MRC will try and protect its members and Vendors.
We have not stopped this thread which is asking for other members to step forward etc.
A post was pulled here because it was going to start a war with another member, which should really be sorted between the 2 involved and I could see that tempers were rising by the huge shouting words, which really is not on. You both need to see each others sides and sort it. It had nothing to do with you v rx.
My phone is always on Kieron, if really busy Im sure you would not mind if I said I\'ll call you back, but would always try and answer it.
Painted housings and knackered end plates sounds familiar. I just had a rebuild around 5K miles after an RX Heaven one and the engine builder found exactly the same.
My engine went pop mainly because bits of paint had flaked off and wormed it\'s way around the engine internals.
Fortunately I had budgeted for a new build and extensive mods to my own spec so it wasn\'t a major issue but had I been skint and had no spare for a rebuild the car would either be a scrapper or sat on my drive still...
DC
DC.....ok i now see what i missed!!
can you please please mail me at JM-garage@hotmail.com i could be very very greatful, cheers
My position still stands, I am not looking for compensation from them, I am not taking them to court over this, I owe them £2000 but I am not going to pay them out of principal. Would you if you were in my position?
I am happy to provide evidance to McCarthy and his solicitor to help them win.
Interestingly enough, I found a thread on another forum (this thread wasn’t removed or deleted thankfully) warning people off Nigel Fright and RX Heaven.
I feel that I have every right to post this thread on the forum as the person went to court and won! Feel free to make up your own minds, I am not trying to make the world a better place, I am trying to help out people in our community by providing them evidence through pictures and other peoples experiences with them.
Thank you Dai Capp for your support and thank you to everyone who has sent me an e-mail and a PM, I understand that you can’t publicly air your opinions but I’d love it if you came forward!
Happy reading.

It seems like there is something in the air at the moment with these sorts of threads. There has been a heated one on the Skylineowners club about a well respected Jap car seller and because of this the moderators have put messages out about posting on an open forum.
Hope everything works out ok for everyone,
Gareth
maybe peolpe are getting fed up of being rip off, i don\'t see why the public that fund these guys businesses should out up with it. I am so i\'m doing something about it.
Here, here, this is a damn insightful thread. Well done for letting the rest of us know to air on the side of caution with this outfit.
QuoteHe recieved a slap the day the cannonbal started
This had me ROFL :D
I think with regards to MRC the reason you get certain threads blocked or removed is due to the legal drawbacks that could face the club.
As this is a public forum if you damn a certain company they could take action against the place this damning took place eg - MRC, which is why you guys have been asked to air no complaints until after your courtcase and the result.
YES - we need to be aware of certain complications or rip-offs but try to see it from the clubs point of view please.
I am no mod but just trying to make everyone understand why the threads may be blocked / removed / edited.
Gurj
Funny, I thought we\'d agreed to leave this alone until the affected parties had finished the legal process?
Nothing unusual here  It seems to me all you have to do is shout the loudest and everyone has to agree.
In all my dealing either in the public domain or with a private individual I have ALWAYS found it best to sort it directly rather than do all my shouting in public, all this does is make that company [or individual] more retisant in comming foreward with a satisfactory conclusion.
My point is there is allways 2 sides to every story and programms like \'whatchdog\' have a lot to answer for :reallymad
Just my 2p\'s worth
Do you honestly believe these companies [they have been mentioned] are still trading after many years because they are c##p? sure, things go wrong from time to time [even for the \'great\' companies] but, you pay your money and you expect a \'fair\' deal, if you dont you go to that company and try to get satisfaction, if you dont, then you name and shame............ NOT BEFORE
Sorry john did you not read the two links that kieron posted??? I\'m not getting into the argument with you as it has nothing to do with you, and myself and kieron both are aware of who you are in agreement with!!!!!
I mean the above with no insult but surely with the facts put out you can see our argument??? Unless of course you are unaware of all the facts, most of which cannot be aired on public forums until the case is over for legal reasons, which would mean you have only really herd RX Heavens side of the story in which case how can a comment be made.
Yes there are always to side to the story...... but facts in hand are all 5 people involved 2 MRC, 1 FDUK, 2 cannonball run europe have all been are in one way or another out of pocket or have engine\'s that have blown? not all rotary either????
I stand by my veiws on the matter. If i was the only person this had happened to then i would understand but i\'m not.
Im no really sure how far things have gone between RXheaven and you chaps involved regarding sorting out compensation etc. But if none of this has been finalised I from an unbiased and uninvolved point of view can see how this would be damaging to MRC, and to RXheaven....(wait dont flame me yet!)
Before I get flamed what I mean is, if a company makes a mistake (it happens) and is prepared to rectify, then yes you may be ****ed about it but as long as your not out of pocket and you end up with good result you cant really knock the company, they could of had hundreds of happy customers with no probs at all...but if company aren\'t sorting it out (or are giving you threatening phone calls!) then yes publicly flame them...from what i\'ve read so far it looks like RX heaven are the ones who are in the wrong...but basically im just justifying what people have said about posting things on a public forum, if its gone past a certain point then yes feel free, warn everyone off and save a lot of people a lot of hassle, but if it aint got that far yet best to keep it private till conclusion (BTW can emphasise with you Kieron/McCarthy, if my brand new engine had gone pop id be majorly ****ed too...and like I said earlier, if they dont sort it out hang them out to dry!)
I had a few glasses of vino, so if some of that dont make sense you know why :)

keiron & Mccarthy hope all goes well for you guys im on your side all the way in this 1. I think painted old housings and old end plates IS going too far imo, especially when you have paid top dollar for a pro job. Thanks for posting all this info about a bunch of slippery dodgy cowboys! Ive noticed how mrc are covering there own ass about all this, but never did a thing when hurley were being slagged off.
See what your saying but hurley was never a fully paid vendor, mrc must have an obligation (at least until everything is final and settled) to protect its vendors as well as it members. Dont get me wrong i\'d like to be the first to know if theres a company giving dodgy rebuilds(which looks the case here), but id also like to give the company time to react before their reputation is damaged beyond repair.
I hope you see where im coming from..not trying to protect the bad companys just tryin to keep the good ones that make mistakes in good standing....(from pics/evidence seen i think rxheaven may not be in good standing!)
Quote from: McCARTHYSorry john did you not read the two links that kieron posted??? I\'m not getting into the argument with you as it has nothing to do with you, and myself and kieron both are aware of who you are in agreement with!!!!!
Sorry old boy you have a bit of red mist in your eyes, I have not sided with anyone. My point was you should sort this in private, surely with a pending court case you can at least wait for the outcome, the words \'slander\' and \'deformation\' come to mind and I think it best that these issues should be resolved prefurably between the company and yourselves, failing that take them to court, when you have a result then is the time to air your feelings.
The fact that you feel hard done by is only half the case, the other half is from the company and quite rightly they are not airing any views on an open forum.
Personaly I think you will get a better result by talking directly to the owner of the company rather than bringing things like this to the forum.

The funny thing is, the \'First\' thread which is \'also a Sticky\', is called \'THE TRUTH ABOUT TUNERS\'.
I thought having a thread made to be a permanant fixture(sticky) \'from the Mods\' like that, meant it\'s alright to say your experiences about \'Tuners or others\' freely, wether it\'s good or bad experiences!
Have I got this wrong?
Quote from: John YorkePersonaly I think you will get a better result by talking directly to the owner of the company rather than bringing things like this to the forum.
No red mist all. I won\'t say this who thing isn\'t annoying but if you bought a car over a year ago and its ony been on the road a 4-5months tops then you be bit a little annoyed as well, anyone who said it wouldn\'t annoythem would be lying
I have tried to talk to RX Heaven direct on a number of occasions and it was in fact RX Heaven that broke the contact with me and refused to speak to me direct. So that route has been tried. I mean no offense to you if any has been caused i do apologies as You have helped me on a couple of this in the past and for this i am greatful. but poeple do need to be aware of things like this so a more calculated dession when choosing a tuner. All companies make honest mistakes they really do but the position i have been put i feel this is not the case.
I would like nothing more than to settle this without all the legal stuff but as i say they are in the wrong and they say im in the wrong its very hard to come to a mutual agreement. All the facts cannot be aired on a public forum as 1 there are to many 2 there are to sides to the story 3 it would just come to an on line brawl with all sorts of people jumping in which would only irrerate the matter. People cannot comment with out all the facts, but as we know now of 5 people that have had the same problem with the same company something is deffiantly amiss somewhere.
I have said nothing slanderous or miss leading as any thing i have said on the forum has been submitt towards the legal proceedings and solicitor.
OK people i\'m donig this off my own back.......
Lets drop this for now before we get back to where we wear with the privious thread. Upon close of the legal proceedings i will post all events from start to now with the car regardless of the outcome. I will use ALL facts use by my solicitors, photo\'s etc.......
This i feel is fair and from this peole own oppinion can be made. Is this ok with the moderators.

About 18 months ago i had an engine rebuilt on a previous car (v6) continuously had problems with it until it died and took much longer than expected for the work to be done on it, there were a number of other problems i had with the company including damage to the vehicle but that is a different story.
Anyways
i contacted trading standards (who are absolutely powerless) but they are good at recomending free advise and filling in forms. together with them we formed a case against this company who charged me £1200 for crap work. But as i paid by credit card we actually took the credit card company to court as they are more likely to pay and are apparently responsible as they allow them to take cards.
it cost £120 to take them to court and they continuously said that they were not going to pay out until 3 days before the hearing when i recoeved a cheque for £1900 pounds, total price of the work done plus damages plus the cost of an additional car i had to buy.
all i did was have 2 surveys done on the vehicle, 1 from the main dealer and the second from a respected tuner staing the problems and a copy of all dealings with the company.
It took 6 months to sort out through the legal system
Moral of the story pay by credit card if poss
As a true independent I find the recent ramblings on the site quite incredible.
It seems that there are many people who have more money than grey cells in their heads! If you are going to play with basic parameters and not monitor what you are doing on any engine the outcome is always the same! Critical parameters like boost and fuelling are the key to this whole issue.
The modern Wankel is a very compact and well-established unit, the designers have already done all the things that you boy racers have done and more. They know that ultimate performance and longevity are always a dream that is never possible. The performance gains are always linked exponentially to useable life of the engine.
Now some of you are going to say that you can do this and that and get away with it, I am saying that if you increase output and then always drive the thing using that extra output you will defiantly end up with a very short overall run time. The wise among you have sussed that if you have the ability to use extra power gains for just a few head turning moments and then drive within the normal parameters you have the recipe for the best compromise.
There has been a lot of criticism of rebuild quality recently, but it has always been levelled after a blow up. Let me say one thing right now, a post mortem on a destroyed engine reveals very little unless you have the expertise of NASA and their budget! If you want to comment on engineering expertise, build quality etc then the engine must be stripped and examined by a third party before it is even run! That is when you can check the flatness of the end plates; tip clearances, housing condition etc.
I suspect the real problem here is simply that some of you just can’t do what you are told when you pick up your new toy and thereafter are looking for someone to blame for your basic stupidity!

Can see where your coming from with this (cant agree or disagree with it though due to lack of experinence), but one of the major points that has been brought up here is the fact that the engine was sold as a street ported engine, where it is now plain to see its not...

Your post was rubbish! :flamed
"This is my opinion,"..... before the jolly boys jump on me!
Welcome to the board TecVet... Some interesting points raised in your post, one small concern is that Kieron paid to have things done to the engine... that well... Just didnt happen! Irrespective of how he drove it afterwards or how long it lasted... what was asked of the engine builder and what the engine builder stated were simply lies.
As for McCarthy, I am close friends with him and that car was not right from the start! McCarthy is a firm believer in monitoring everything the engine is doing, his brother builds race tuned and drag bikes for a living so McCarthy has a good background. McCarthy reported straight away his concerns about the over boosting levels and was told not to do anything, NOT BEING A FOOL he sought additional advice and was informed that the whole set up was incorrect and managed to get the boost down enough to get back to the engine builder... (at this point I went back with him to see the outcome) The engineer and his mate had a fiddle and low and behold the engine went BANG a few hundred miles later.
We are all aware of the decreased life of an engine as soon as you put more strain on it, and everyone will agree that monitoring the levels is important... and on that note (shameless plug) I have 3 HKS 60mm Gauges for sale TEMP, BOOST, Oil/Water PRESURE £80 each or £210 for all three... Check out the classifieds on the forum for details under the thread "Not specifically for the rex..." :D :D :D :D
Trex,
I\'m interested to know how many engines you have personally rebuilt using your own machine shop?

I must say that I don\'t completely agree with some of your comments here.
It is perfectly possible to see if a rotary engine was built poorly and contributed to it\'s demise once stripped down without the budget of NASA.
The ones pictured on here are not damaged beyond the point that you cannot see the condtion of the housings at the time of build.
These engines if built and tuned properly can take alot of high stress and power, and they certainly were not designed to just pootle almost everywhere with the very occasional use of revs and power. The RX7 is a pure sports car after all.
Regards
Carl
Tec Vet,
Welcome to the forum, i as well as few others feel that your first post may have been missing the point of the thread.
It is stated earlier in the thread that the fact the car blew up is not in question, the fact that porting and new housings or plates were paid for and not supplied is the fact in dispute. I dont personally know the in\'s and out\'s of the dispute as i didnt see the first thread and dont know the people concerned.
You seem to be going on about boy racers fiddling with their cars and blowing them up while expecting longevity. This thread is not about that.
I dont know how long you have been viewing the forum but the subject that you raised has been discussed many times. I am sure nearly all the members of the club are well aware that if you increase power you will decrease the life of the engine. Even more so if you dont do it properly.
As for your point about Mazda doing all their research and testing, it\'s quite an obvious fact that they have, but they provide a car that is compramised between a good amount of power but more importantly, reliability and longevity.
I have owned many RX7s and have built quite a few engines (in a machine shop), although i am not a mechanic or Tuner and the engines have only been my own, i am still learning, but i own these cars because i want a fast one and if it only lasts 8000 miles, then i am more than happy as it has 475 fwhp. Needless to say i wouldnt do it to a daily driver.
My last point concerns your comments about boyracers, all the people i know with very powerfull RX7\'s are over 30 inc me..............
I hope you enjoy the forum and will find it useful but please be mindfull when posting your comments....
I have stripped and built Rotarys for the record...
This does not make me an expert by no means.
But I know from experience and intelligence that you do not need a budget of \'NASA\' or as drastically/dramatically as you made it sound to diagnose internal engine damage!
If this is the case all the good Tuners here, wether it be WGT, re worx,, rx motors, haywood etc having been ripping peeps off for years then, as I know they don\'t have NASA\'s budget!
Actually this goes for MAZDA themselves... Yeah what do they know!
Well said Carl!

TecVet,
I think you should read this post before jumping in with comments. I don\'t build engines but I know this very small but curtail bit of information.
If you are charged for parts/work and its not done then you are a person with very little morals, this seems to be the case here. If you read the whole post I think it would become clear.
Well said Carl. You are a well respected engine builder and you know what you’re talking about, an engine can be inspected and faults diagnosed post-Morton, without NASA\'s help!.
It annoys me when a new member comes on here and jumps in with comments that seem very poor (just MY opinion!) and I don\'t really think you are here to benefit the club but to give some kind of support to the people whose workmanship is in question. But that is me making assumptions, I don\'t know who you are so I shall hold any more thoughts as I do hope you have joined this club to benefit the members with your knowledge as others have done.
TecVet, are you in any way associated with the organization at the point of this thread? just sounded like you were putting the boot in from the otherside of the fence.

Hi Guys,
Lets try and stick to facts on this thread please and not hearsay or conjecture, if people have hard facts fair enough but this thread is messy enough as it is, with loads of implications for every one especially the people directly connected.
Scuttle, well done with the thread after you had a little drink, spot on mister, from the clubs prospective we are trying to the best we can to support both club members and a paying Vendor.
BTW, T Rex is right it should be in another section, so when this is all resolved one way or the other this thread will be put it the "Truth about Tuners" section till then lets keep this thread as honest as you all can and await the outcome.
Clive & Glenn
Seems to me we have resorted to the original thread :(
Please understand I am not trying to inflame the situation but, all that has been posted on this thread has come from one side, up to now the vendor in question has not responded to these acusations even to acknowledge there is a dispute. This I feel is only making the matter worse for him and I would strongly recommend that he makes some form of statement if he wishes to maintain some credibility.
One sided arguments are not only very damaging to the company in question but also put MRC in a bad light, to allow this thread to continue without any form of cautionary notes is somewhat unfair seeing as you have on one side MRC members [who can lay accusations willy - nilly and seem to be able to post what they like] and on the other a fully paid up vendor [who todate has not made any statement].
Sorry guys this is all very unfair as sofar nothing has been proven.
As for Mr Tec vec - what are you on? I think you have missed the point compleatly.
I know my £20 is nothing to the £300ish RX-H have to pay but I thank MRC for not deleting this thread!!!
The main issue is I am being charged for a street ported, rebuilt engine. Even if RX-H rebild there engines using old and worn parts it is obveous that the engine wasnt ported and that this thread shoul stay alive. Thanks for the free bumps and interest :cheers
Tomorrow should be a better day :evillaugh
I feel bound to ask if any member of this forum has a genuine, positive, customer experience to offer in the interests of balance?
Otherwise, as there has been no (direct?) acknowledgement from the vendor that the issues even exist and in the face of an obvious disinclination to engage in public debate, I think it would actually be in the best interests of the members directly involved to park this temporarily until judgement is rendered. As part of the public record, the content of any case and decision can then be reported fully.
It may be \'the other side\' chooses not to comment due to the impending court case. Such a course of (in)action possibly being based on current legal advice or just on experience of the judicial system.
If the original post was intended as a cautionary tale offered as a heads up to others, I think it\'s fair to say we will have got part one of the message.
Well done to McCarthy for trying to lower the temperature. Hope the b-day night out went well! :)

All work completed on my car by this garage has been excellent.
I had no problem with after sale service either - a couple of small examples.
- My battery wouldn\'t hold charge, so was given a brand new one at no charge.
- Clutch hose split. Car was collected, fitted with a new hose and delivered back at no charge.
Not major problems I know, but these are the only things that have gone wrong in the year or so that I have owned it and both were sorted with no questions asked.
Just my 2p!

Think you will find if you look at the posts I have made I have said exactly that, I for one would much prefure this thread removed untill the said court cases are resolved and both parties THEN putting their sides of the story, failing that, yes, RXH should issue some form of intent and the thread then closed.

Well it seems that although most of you understood where I am coming from a small percentage did not! I meant to provoke reaction; ideally to make you all stand back a little and see the big picture. For those who are still having difficulty I would like you to imagine what would have happened if Mazda had supplied the engine. Driven, as before with the same setup fuel and boost parameters it’s a fair bet that the engine would be destroyed. Would the finger then be pointed at Mazda?
I am not too interested in the porting issue; I do have suspicions but would like to see the invoice for the job first!
TecVet
From my limited viewing of this post it is claimed that new parts were paid for and used ones supplied.
So the answer to your question is yes, if Mazda claimed the parts were new and they weren\'t I would throw it back at them - no proplem.
I don\'t know they guy having this issue but the crux seems to be he didn\'t get the NEW PARTS he paid for not how long they lasted.
Someone correct my assumption if I\'m wrong....................

As for people understanding where you are coming from? what exactly are you trying to say because this is unclear....... That we are all boy racers because we have and intrest in modified cars??? That people can\'t listen to advice of others???
and yes if you bought a car from mazda with a fuel set up and boost preamiters (as ever turbo charged car on the road would have??? ) and it blew up yes the finger would be pointed at mazda. If a car is bought from any dealer and it blows the fingure is pointed at who ever sold it.

Ok, just to clarify here as people seem to be getting confused as to the point(s) I\'m trying to make.
1) My original post was to point out the inherent flaws in checking the quality of a rebuild after it has failed. (This matter was raised, the question of porting does not apply to this point)
2) I’m led to believe that two of these engines were run outside of safe parameters, therefore regardless of the parts used or the quality of the rebuild failure was inevitable.
3) If you have been charged for new parts then yes they should be present in the engine. Used parts that are still within tolerance are quite acceptable for further use and I’m led to believe this is standard practise.
The reason I’ve chosen now to respond to a thread is quite simple, there seems to be a real belief in this online community that poor engineering is responsible for these failures when clearly the failures have been caused by the engines running outside of safe working boost and fuelling levels, These parameters being freely adjustable by the user in some circumstances. When you are aware of a problem you keep off of the boost until it is rectified.
You know that continual use of the car outside of the maximum parameters will result in disaster.

Why would Mazda let a car go out of the factory with a known potential engine failure issue? Oh,that\'s right, they wouldn\'t.Otherwise they certainly would not give a warranty.
It would be logical for a specialist to do the same and exercise the same cautions with their rebuilds.Build quality does also help greatly in the longevity of these engines.

Carl

IVe had problems with some work done before at a tuner back when I had my Pulsar. Things is they were totally brilliant at fixing it, and didnt charge for bits and bobs etc to make up for it.
So ok I had a problem, but everyone will make a mistake at some point. It is how its resolved thats important and in this case I was impressed.

Based on the recent postings on this forum by the above mentioned individuals, our response is as follows:
RX-Heaven takes great pride in its level of expertise, workmanship and overall level of professionalism. We take our business very seriously, to which the majority of our customers will attest.
We have naturally followed the comments posted on this forum with great interest and a mixture of emotions, however we feel it would be beneath our professional integrity to contribute to a public slanging match, or air our position publicly, despite the fact that a lot of potentially damaging unfounded and uncorroborated comments have been unfairly levelled against us.
The only comment we will make is that we have been in business long enough to know that you only survive by giving a genuine level of customer service that is above all fair. Many of you, our valued customers, have made contact with us & confirmed that to us.
If anything ever goes wrong through faulty workmanship or components, then we strive to address the situation to the customers satisfaction.
However when things cannot be resolved through the normal process, as does happen from time to time, then we are happy to use the due process of the legal system, and abide by the findings of a County Court Judge.
We are not prepared to make comment on this forum about the particular disputes between ourselves and James McCarthy or Kieron Ash; we will reserve that priviledge until we are sitting in front of a Judge.
What we will do in each case, however, is publish the Judges finding in full for all to see. We have nothing to hide, and in line with our professionalism, if judgement is found against us, we will hold our hand up and abide by any ruling made.
One final point: We greatly value all our customers and apologise for any unnecessary anxiety caused as a result of the postings on this forum. We trust that by making this statement it will put an end to the matter for the time being, and allow everyone to get on with enjoying the cars that we jointly love.
This is the only post that RX-Heaven Ltd will make on this issue until there is a final outcome of the legal process .

And John, before you reply, YES I have mentioned these facts before, none of which rx heaven have replied too and I just like to remind people about the facts of my despute with them.

This issue is highly emotive.
But those who wish to post should choose their words very carefully,if you are involved directly then do not let it get into a personal conflict.
If you are directly/indirectly swept up in this then make sure of your fact\'s,and know what you are speaking about firsthand. If there is legal action, then save it for that.
The Response of Nigel of RX Heaven was certainly in that vein,it was not a character assassination of anyone, just cold hard facts.
Remember that in any situation in life, if things go too far it can lead to very dramatic consequences,ie,alot of money spent with no real satisfactory result for anyone concerned. Then having to pay for it for along time after, both emotionally and physically and financially. This can apply to all concerned.
Sometimes you have to put things down to experience, and move on.
If you think you can handle all of the consequences, then take legal action as the absolute very last resort.Remember that Laywers are expensive, and often legal procedures drag out and become very expensive very fast.Once the train has left the station it is very hard to know when to get off.
Even though there have been some previous discussions between all parties,it would be very wise to really try to exhaust absolutely every other available the communication option before taking legal action.
This advice is not being given with any bias, but all concerned may need to try to calm down when communicating with one another.
Start by asking yourselves what you really want out of this? In all cases it should be a satisfactory outcome, all may have to compromise a little, but communicate in such a way that all stand to gain something and no one loses\'s out completely.
Don\'t go into any discussion without leaving the other party with some options, there must be give and take, and really try to listen to each other.
That way you just might get a suprise at how reasonably you can resolve things.
If laywers get involved then they will be the only real winners. That is a fact of life.
One final thought, maybe someone could act as a go between between both parties to try to resolve this in a reasonable fashion.Think about it,an independant party/go between, may be of great value in starting off discusions once again.

Carl
I have kept up with this thread\'s comments, and I hope for all those involved that it is resolved in a suitable manner.
What Carl mentioned above seems like a good alternative idea to legal proceedings and is used often in my chosen profession as a way of settling a dispute between two parties without going to court and appointing legal representation, and is called \'alternative dispute resolution\'. There are several routes, including arbitration, adjudication or mediation, depending on if the two respective parties can stand being in a room together, on how the final outcome is decided and on the size and complexity of the dispute.
Mediation means the ultimate decision is made by an unbiased third party. Meetings take place with the separate parties in the aim of achieving a settlement. Ordinarily the mediator does not make recommendations only helps assist parties in making an agreement.
Arbitration is whereby the parties to a dispute agree to submit their respective positions (through agreement or hearing) to a neutral third party (the arbitrator) for resolution.
Adjudication is a quick fix remedy prior to extensive legal action by which an independent third party makes a quick decision when parties are unable to agree on a matter. It aims to gain a third party decision. Decision must be made within a certain time period.
I hope this may be of some benefit. And I am not a lawyer so don\'t ask me any technical questions, I am only aware that these systems exist for similar situations.

One of the most helpful posts I have ever read on any forum! Gonne get a good reputation vote for that one :cheers

oh ok cool, sorry i logged off just after i posted to watch some more of family guy on DVD.
Carl, unfortunatly you can only resolve things amicably if both side are prepared to talk and come to a mutual agreement. Unfortunatly on this occasions (i think i said this before) RX Heaven broke communication with me and say if we wanted any futher communication it would be through a solicitor. Hear are the facts from my case:
car sold with a street ported engine, it didn\'t have one
car sold with a HKS twin plate clutch , it didn\'t have one
Exhaust baffle fell out the system the car was supplied with (i paid for i to be replaced)
Boost problems that were never rectified after trips back to RX Heaven, i seeked other advice form a different tuner by then it was to late and the damage was done resulting in 1st engine letting go in 1200miles
Upon collection of the the car after the 2nd engine was built it took over 45mins to get it started (have witnesses)
2nd engine let go after 160 miles (have witnesses)
When the car was collected by nigel of RX Heaven. He pulled up onto the back of a low loader, cracking the skirts and dragging my exhaust along the ground Also He hosted it to far forward by pulling the veilside front valance into and over the wintch damading body work, cracking the splitter (have witnesses)
After sales service was very poor. RX Heaven would not return my calls i had to keep phoning until i got hold of nigel.
On the hole not the best experiance i have ever had with tuners in the past.
Until nigel borke contact with me and we had to go down the leagl route.
I understand where you are coming from with both sides needing to be amicable over this.
What if there was someone who managed to get all parties talking again?
Would you be willing to come to the party as it were?
If you were then that would be a start where maybe some of this could be resolved in the absolute best possible way for all concerned.
That has got to be a better route than any form of legal action.
It just needs one person to be willing, then maybe the others will follow.
Any volunteers to be first?
Regards
Carl
I would be more than willing. I don\'t think that it is me you need to convince.

OK,
Then I would be willing to try to have a chat with you all individually and see if it is possible to come to some sort of amicable agreement between you.
I now have 2 of you on board with this idea, and just need one other party to come forward.
Please contact me privately preferably by phone.
This evening would be good on 01635 846598
May I strongly suggest that any further comments on the subject from the parties involved be halted for a while in order that no more complications are added.
Regards
Carl
I\'m up for that, it\'s them who is threatening me with legal action. I\'ll call later, what time is best for you?

Hi All,
We feel the time as come to leave this thread dormant unless someone comes forward with hard facts only surrounding anything that is connected with this thread.
This thread has been left open so that anyone can post information or comments surrounding the unfortunate situation that all parties have now found themselves in, but from now on anything other than FACT that can be substantiated posted on this thread will be moderated.
Clive/Glenn
I will have a full report on monday which I will send to MRC Admin before posting.
Kieron, send the V5 off to DVLA will ya. I\'ve just received a letter from DVLA telling me I\'m still the registered keeper, along with a fine of £40 for having an untaxed vehicle :spank
About par for the course
"I will have a full report on monday which I will send to MRC Admin before posting."
Anything to report Keiron?
