Well, I had a nice suprise waiting on the doormat for me when I returned from work last night, courtesy of the Dorset Magistrates Court. A summons to appear before the Magistrates for excessive speeding (100mph) in a temporary speed limit zone, 70mph, 60mph, 50mph (whatever that means - it was a dual carriageway in the middle of fields which is 70mph???). Ive got a clean license and 5 years no claims. I think I may well be saying bye bye to my license, and my car!
sob!
You will only get a straight ban if the speed is in excess of 100mph. below that maybe an excessive amount of points and a hefty fine that the best you can now hopw for sorry!
how did they get you, presuming it was you(if evidence doesnt prove it then you might be able to play the ringer card) obviously get all evidence etc before hand, brief, plead you need it for work etc etc.....

Good luck
Si
Wiltshire just got me at 88 in a 60. I have asked to see the photographic evidence they say they had to \'help identify the drive\'. They have sent back three still all from the rear of the car, cant even make out if there are people in it!
Not sure where Im gonna take it from here.........
If the notice was sent to you within 2 weeks of the offence you have to identify the driver then the summons is issued. If, however, you received the initial "who was driving" form after two weeks you can legimatly send it back saying you cannot remember.
I had a narrow escape on a holiday before christmas. We were travelling into sheffield on a dual carridgeway with a 50mph speed limit. I was doing 70 when I passed the speed camera in the back of a van pointing straight at me. The weather was good, I was in the outside lane - there could be no way the guy operating the camera didn\'t get me. but I was in a hire car with 2 drivers insured to drive it... I still haven\'t heard a thing about it yet!
I guess the ojimathingy form would have gone to the hire company to ask who was driving. They would have had to have replied that they didn\'t know as 2 people could have been driving. Hey presto the fuz can\'t prove it was me...
Eyedee - bad news mate.
Was it on the A303? There are a few roadworks going on at the mo with temporary speed limits, the scamera partnerships patrol these areas.
You wont always get banned for over a 100, but they do take a dim view of it through roadworks.
Are you sure it was you driving??
//www.pepipoo.com has some usefull info.
Also //www.pistonheads.com , you\'ll need to register, then click on forums, then \'speed plod and the law\' . Some very helpfull advice to be had there.
Goodluck.

On motorways you can get away with a FP fine up to 96mph, more and you\'re in court whatever and can be banned - I was there a couple of years back. +100mph often a ban but its not automatic - guy in court with me got points for 104mph.
You may \'get lucky\' and get 5-6 points and a chunky fine. Otherwise it will likely be a ban of 28 days, may be a couple of months depending on your circumstances.
20b boy
have some one that works in traffic and is mate its 100 or more than 100 is an instant ban i havent just made that up!
Don\'t believe everything you hear, I didn\'t get a ban,
However consider my self very lucky, unfortunetly it has
some what ruined my enjoyment of driving since scared
to just creep over by a fraction of any speed limit.
But i\'m geting over it.
Good luck
Paul..

Thanks Paul.
Mr 7: I didnt make it up either
I was told while sat in the back of a traffic car - and then witnessed a fat old guy in a Merc get let off with no ban and 1 point and a £150 less of a fine than me - he was doing 104, I was doing 98.
You get a summons = u go to court = its down to those old codgers with the wigs to do with u what they what - which is totally at their descretion...to ban or not to ban, that is the question...

Mike, not to lose you sleep or anything but the hire company, if informed within 2 weeks, will have returned both drivers information to the scamera operators. The petty Hitlers then have as much time as they like - up to 6 months to contact you for further info on the driver...
I got taken to court for Dangerous Driving. It was complete bollox. The cops were chasing some guy in a bravo HGT. They clocked HIS speed at 64 mph before he passed me, and 96 mph after he passed me. the coppers pulled him at the next traffic lights, and pulled me over too! I thought they had bigger fish to fry as this guy was driving like an arse, but i admit i was speeding, think i was doin about 40-45mph (it was a 30 at 2 am, three lanes in either directionwith fields on either side of the rd that runs staight for about 2 miles) They said i was racing this idiot, and were taking me to court?????
Anyway, they gave me a plee bargain, if i admitted to doing HIS speed (since they didn\'t have mine) they would drop the charge to driving without due care and attention, and speeding. ended up with 9 points and a £60 fine since i was in uni at the time, i played the: "need his car for commuting, never been in trouble before, and 9 points will put me on EXTREAMLY thin ice for 3 years, so not likely to re offend." card, and they took that highly into consideration when deciding the punishment.
The only thing i didn\'t do that i think would have helped is say i go to see my nan on weekends to sit with her. If you do any volenteer work, stress that you need your car for it. if you don\'t it may be a good idea to do some, then you can say it. Anything to do with under privilaged children/disabled/elderly is looked on as very comendable. Not to mention the self satisfaction you\'ll get from doing it ;)
Good luck

Bummer!
I think I should add to my post that I was very very lucky
to get away with a big fine and 6 points.I think as rule you would
get a ban over a 100, would\'nt want any one to get the wrong Idea.
I have to say it has totally changed the way I drive now, and
may not be a bad thing, I\'m a bit like a reformed smoker if
thats a way of describing it. The going to court and being
pulled out of the car wer\'nt realy nice experiences,I;ve wanted
to sort of say this for along time.
So have fun guys but do go carefull.
Paul..
over 100 is not always an instant ban, depends on circumstances and speed limit at the time
Believe me I know
A guy I know was done for doing 104mph and got a 3 month ban. During the ban his insurance was due for renewal. His premium actually came down (yes he did inform them of the ban). They said that a 3 month ban can have less an effect on the premium than 6 points.
He drives a \'02 Elise.
Insurance is a very funny thing!!
I was banned for 28 days once, and my premium went down at renewal, probably helped by another year of NCB
At court I requested to be banned rather than have points as I knew six points would have a worse effect insurance wise
I got done for doing 101.6 on the motorway years ago , I was expecting minimum of 3 month ban but I got away with 14 days and £150 fine , speedings not big or clever but I walked out of court laughing
get yourself a letter from a character witness and if possible a letter fom your boss that states you need your licence for your job , having a clean licence is foing to help big time aswell , I already had 3 points on my licence which was made worse by the fact I got them inbetween getting pulled and going to court so I couldn\'t say it was just a one off
Good luck
Thanks for all your help and opinions! I got caught by a Laser triggered Gatso on my journey to holiday weekending in Dorset in the Summer of last year. I asked for the photos of my car, but unfortunately had already admitted it was me before receiving the photos of the back of my car, which looked like it had blacked out windows! You couldnt see a thing inside. But, it was too late and not knowing how fast I had been going, I assumed it would be a 3-6 pointer, but I received a summons instead. :(
Regarding what a few of you said about a ban being better for your insurance than points; I was thinking that may be the case, so I looked into it, and I read that a ban never leaves your license whereas points leave after 5 years (Police recorded for 7 years or something). Does anyone know if this is true?
I ride a sports bike to work everyday, which is more handy than necessary to be perfectly honest. And if I got the boss to say I need the bike for deliveries etc. I\'m not covered on my motorcycle insurance for that. I can\'t think of anything clever to say other than how sorry I am for my actions, and my short temporary lapse of comtemplation for safety of other road users and myself. That I feel ashamed and dissapointed with myself for creating this unneccessary and stupidity driven situation. (tear in the eye)... I shall ensure I am fully aware of my speed at all times in the future and can only reach out to the good Chief Justices\' to show some sense of compassion for the remorse that I... Well maybe not quite that far, but you get the idea! ;) Its just annoying that I have to drive from my house in London to Dorset to go to court!
I have to send my letter of notification of plee - guilty or not guilty (Guilty as charged) tomorrow.
Thanks again for all your help people. I\'ts really nice to be part of a forum of decent car enthusiasts.
Hi Eyedee ,
regarding the ban never leaving your licence , this is untrue unless things have changed in recent years , my 14 day ban came off my licence after 4 years same as points and even my DR10 will come off after 11 years ( 4 years to go ) the insurance companies don\'t even count the DR10 as its over 5 years old even though its still on my licence
If you can\'t make it to court on the day you can always send a letter but I beleive your more likley to receive a bigger conviction , as I said previously I got a 14 day ban and £150 fine for 101.6 with 3 points already on my licence , my boss got done doing a similar speed but sent a letter to court instead of going , he\'d had a clean licence for 10 years and 6 points and a £500 fine
Hi Tintin,
I think I\'ll just wait and see what happens. If they all leave your license, I dont think it will make that much difference to the insurance.
I am going to court. I have been asked in the letter from the Magistrates to send a note saying how I intend to plead, which may help reduce my \'sentence\'.
Did anyone else have to do this?
cheers
Hi,
Well, its all over. And not a bad result IMO. I reached the magistrates court 2 hours early and ended up being seen 1 hour late. But seeing as I had a squeeky clean license and was dressed in a suit (unlike the shellsuit squadies sat around me in the waiting room) and presented myself well, I was given a 7 day ban and a £250 fine including £50 fees. So all in all not too bad.
Thanks for all the advice prior to being seen in court.
Cheers :wave
Not a bad result at all , but I tell you now its going to kill you having your car sat around and not being able to drive it
I just hope you\'ve learnt your leason now and will stick to the speed limits in future , just like me ;)
Thats not bad eh! In those 7 days you\'ll have saved about £50-60 in fuel so the fine won\'t be so bad either.
The best you could have hoped for I guess mate.
So, is getting a ban better than getting say 6 points? Do you now have 12 points for 3 years or is your licence clean after 7 days? I mean if you get 3 more points in a months time do you get banned again or just have 3 points on your licence?
cheers guys. Its actually all done with. I took a week holiday in Dorset straight outta court so by the time I got home, my ban had finished! :rollin
A 7 day (or any length of basic ban) means you have a strike on your license which you must make all insurance companies aware of for up to 5 years - at which point the ban leaves your license. No points, but 6 points is about as bad as a short ban apparantly.
cheers :D
