New Terms and Conditions - Must Read First

MRC Terms and Conditions

This is a legal agreement ("Agreement") between Mazdarotaryclub.com and its members. The Agreement covers, but is not limited to activities of the Club that members may participate in; this includes use of the internet based discussion forum and club events.

Please read the entire Agreement carefully before registering for Mazdarotaryclub.com membership. You agree to be bound by the terms and conditions of this Agreement (the Terms) for as long as you continue to be a Club member or a registered forum user. If you do not agree to the terms, please do not register or buy membership from the site. The terms are subject to change by Mazdarotaryclub.com at any time, effective upon notice to you.

Either you or Mazdarotaryclub.com may terminate your Club membership at any time, for any reason, without explanation, effective upon sending written notice to the other party. Mazdarotaryclub.com reserves the right to immediately suspend or terminate your access to the forum without notice, upon any breach of this Agreement by you which is brought to Mazdarotaryclub.com’s attention. Mazdarotaryclub.com also has the absolute right to refuse entry to a person to a mazdarotaryclub.com event for any reason.

Your membership in Mazdarotaryclub.com is a service for your sole, personal use. You may not authorize others to use your membership, and you may not assign or otherwise transfer your Membership to any other person or entity.  You must not tell anyone else your forum password or allow anyone else to log onto the forum or post under your username. You are responsible for logging out of the forum if your computer is accessible to others. This prevents unauthorized access.


REFUNDS

Membership fees are non-refundable. Any refunds that may be given are at the sole discretion of Mazdarotaryclub.com and are only offered under exceptional circumstances.


ONLINE CONDUCT

As a Member, you agree that:

You are solely responsible for the content or information you publish or display on the Mazdarotaryclub.com forum.

You will not post on Mazdarotaryclub.com, or transmit to other members, any defamatory, inaccurate, abusive, obscene, profane, offensive, sexually oriented, threatening, harassing, racially offensive, or illegal material, or any material that infringes or violates another party\'s rights (including, but not limited to, intellectual property rights, and rights of privacy and publicity).

You will use the Mazdarotaryclub.com forum in a manner consistent with any and all applicable laws and regulations.

You will not include in your profile any offensive anatomical or sexual references, or offensive sexually suggestive or connotative language, and you will not post any photos containing nudity.

You will not engage in advertising to, or solicitation of, other members to buy or sell any products or services through Mazdarotaryclub.com. If Mazdarotaryclub.com decides it is not in the best interest of its Members. Also if this decision is made it is non-reproachable. You will not transmit any chain letters or junk E-mail to other Members.

You are solely responsible for your interactions with other Mazdarotaryclub.com members. Mazdarotaryclub.com reserves the right, but has no obligation, to monitor and / or mediate disputes between you and other Members.

You may not impersonate another person or entity, or falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is posted.

You may not restrict or inhibit any other user from enjoying the Mazdarotaryclub.com Forum or Club in any way.


DISPUTES

If you have a formal dispute with another club member, advisers or guest please try to resolve it by email, PM or telephone conversation. If issues have to go out on the forum then them Mazdarotaryclub.com will operate a one post from each party policy with threads being locked to stop others from joining in.


ADVERTISING AND SELLING

Only registered advertisers may commercially trade on Mazdarotaryclub.com.

You may not advertise or offer to sell any goods for any commercial gain or purpose other than in a private capacity as one forum user to another. You may sell anything you want so long as it does not contravene Mazdarotaryclub.com rules on suitability or content.

You are not allowed to sell more than one of any item, be this a part or a car, per calendar year without written consent from Mazdarotaryclub.com.

All private sales must be submitted for approval by the Mazdarotaryclub.com team in the correct format and the appropriate section of the forum; ‘Submitted Ads - Cars and Items For Sale’. Once approved any items submitted are viewable to members only for the first week.

Members and guests are not allowed to place material, in any way constituting an advertisement in any of their posts, avatars or signatures.

GROUP BUYS

Group buys must, in some way, be relevant to rotary cars or their enjoyment. The team would ask that, before putting the said items up for sale that site advertisers are given the opportunity to match or beat any deals.

All group buys must be conducted within the group buys section only. Group buy’s may not be started on a paying advertiser’s thread, or on any other group buy thread already started by another member or guest.

All group buys must also be operated on a non profit making basis with the goods coming from a registered company not a private enterprise.

No group buys organised by a member or guest are the responsibility of the Club.


 
ONLINE CONTENT

Opinions, advice, statements, offers, or other information or content made available through Mazdarotaryclub.com, but not directly by Mazdarotaryclub.com, are those of their respective authors, and should not necessarily be relied upon. Such authors are solely responsible for such content. Mazdarotaryclub.com does not guarantee the accuracy, completeness, or usefulness of any information on the service and neither adopts nor endorses nor is responsible for the accuracy or reliability of any opinion, advice, or statement made by parties other than Mazdarotaryclub.com. Under no circumstances will Mazdarotaryclub.com be responsible for any loss or damage resulting from anyone\'s reliance on information or other content posted on Mazdarotaryclub.com or transmitted to members.

INDEMNITY BY MEMBER

You will defend, indemnify, and hold harmless Mazdarotaryclub.com, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses (including reasonable legal fees) relating to or arising out of your use of the Mazdarotaryclub.com services and events, including any breach by you of the terms of this Agreement.


PROPRIETARY RIGHTS

Mazdarotaryclub.com owns and retains other proprietary rights in all services offered by Mazdarotaryclub.com


INFORMATION SUPPLIED BY MEMBER

Mazdarotaryclub.com will keep confidential all personal information supplied by you Mazdarotaryclub.com, including credit card number(s), and shall use or disclose such information only for the purposes for which such information was collected, or as required by law. Please see Privacy Statement for more detailed information concerning confidentiality.


COMPLAINTS

To resolve a complaint regarding the Mazdarotaryclub.com service, you should first contact Mazdarotaryclub.com by clicking on the ‘Contact Us’ button or via email to team@mazdarotaryclub.com

Club Constitution and Rules

Section I.  PURPOSES AND GOALS

A.   The stated purpose for Mazdarotaryclub.com (the Club) shall be:

•   To foster and promote an interest in rotary powered vehicles made by Mazda.
•   To disseminate automotive information to enthusiasts through Club events, newsletters, the website and email.
•   Promote recreational activities for the enjoyment of Club members, arrange and promote automotive events (e.g. car shows, open track events, speed trials, etc), and advocate the safe and skilled operation of Mazda rotary powered cars.

Section II. LOGO AND NAME

A.   The Logo shall be similar to the one appearing at the top of this page, unless the committee sees fit to alter it.
B.   The name of this organisation shall be the ‘Mazdarotaryclub.com’

Section III. MEMBERSHIP & DUES

A.   Membership is reserved to people with an interested in Mazda rotary powered cars who support the purposes and objectives of this Club

All prospective members shall be subject to the following:
•   Remittance of annual membership dues
•   Submission of a membership application

B.   All members shall pay annual dues prescribed in the general rules.

•   The membership runs from 1st January until the 31st December.
•   All previous members must renew in January, unless they have joined since the 1st of September of the previous year. (For example any Member joining on the 1st September 2006 will not  have to renew their membership until 1st January 2008).
•   Annual renewal membership fees are payable in full by January 31st each year.
•   Any renewal fees not received by this date will have their ‘MRC Full Club Member’ status changed to ‘MRC Guest’ on the forum and will no longer have access to the Members Section, Private Messages or receive the Rotary Revs newsletter or discounts.    
•   Revocation or cancellation of membership may result from non-payment of fees.
•   Membership fees are non-refundable. Any refunds that may be given are at the sole discretion of Mazdarotaryclub.com and are only offered under exceptional circumstances.

C.   The clubs annual accounts will be posted in the members section of the forum each year, after they have been finalised and authenticated.

D.   In the event of Member misconduct, written notification in the form of a grievance must be submitted to the Committee. The Committee shall in-turn; initiate a status review upon presentation. The resultant action may include cancellation of membership.

Section IV CLUB STRUCTURE AND COMPOSITION

A.   Structure & Composition

•   The Club shall consist of a least a President, Chairman or both, Club Secretary and Treasurer.
•   Additional roles maybe appointed as appropriate to the size of the Club, or as considered necessary.
•   The President and / or Chairman will appoint members to carry out roles such as forum administration and moderation.

B.   Elections

•   The Chairman, Club Secretary and Treasurer positions shall be elected in January each year.
•   To stand for election members must be nominated and seconded.
•   If more than one candidate is nominated for a role all applicants will be asked to submit a manifesto stating why they should be elected and what qualities they can bring to the club.
•   An online forum poll will be held and Club members who do not have internet access will be asked to submit a postal vote.
•   If necessary to fill a vacant position, a member can be appointed part way through the year using the same election process if applicable.

Section V. CHANGES TO THE RULES

A.   Membership fees and schedules shall be established by the President, Chairman, Club Secretary and Treasurer.
B.   Annual membership renewal fees for 2008 are £25.00 per individual and £35.00 for family membership. New Membership for 2008 is £30.00. This may or may not change in subsequent years.
C.   All Club Members must have a valid driving licences and shall maintain adequate vehicle liability insurance coverage when driving their vehicles, either on the road or at any event.
D.   All event co-ordinators must be Club Members.
E.   An individual’s forum password for the Members Only section will not be disclosed to any other person.
F.   Membership numbers will only be used by the registered member to obtain discounts for their personal benefit, and are not for use by others.
G.   Members’ e-mail address on the newsletter mailing or other personal details, however else            Obtained, should not be disclosed to non-members, or any business, without the express permission of the member concerned.
H.   No member should use information, such as the newsletter mailing list to benefit any business whether rotary related or not.
I.   When at any event, whether organised directly by the Club or not, all members will behave in a suitable way that will not damage the Club or its reputation.

Section VI - DISCLAIMER        

A.   The Club accepts no responsibility for any loss or damage caused by the following advice given in the Club newsletter, on the Club website, other through use of any of the specialists or Insurance companies listed.
B.   The Club does not recommend any one supplier or vendor of parts, service or insurance company over any other.
C.   The Club cannot guarantee that any supplier or vendor will give any discount to members.
